Durrës Customs has fined the company “Salillari” with 5.1 million euros for evading oil taxes. Decision No. 626 of the customs authorities has established the emergence of a customs debt due to non-compliance with procedures for an amount of over 1.32 million kilograms of fuel, which was declared under the NATO tax exemption regime.
According to official documentation obtained by the customs investigation in the Porto Romano Sector, the company “Salillari” had obtained an exemption authorization (No. 14695) for the import of materials that would serve exclusively for the construction project of the NATO Air Base in Kuçova. This legal status allowed the goods designated for the base to be exempt from VAT, excise duty or customs duties.
During field inspections and verification of the Asycuda computer system, customs auditors discovered that for a quantity of 1.3 million kg of 10ppm diesel, the company had not submitted any specific exemption request approved by the NATO Support and Procurement Agency (NSPA).
Due to the lack of this specific authorizing document at the time of customs clearance, the authorities legally considered this quantity as “goods in free circulation” not declared under the exemption regime. The initial unpaid duty calculated by customs amounted to 156 million lek, which included 60.4 million lek of excise duty, 48 million lek of VAT, 42.7 million lek of turnover tax and 4.7 million lek of carbon tax.

After the case was classified as a customs administrative offense committed through negligence (Article 252, for failure to comply with deadlines and procedures), the legal sanction of twice the missing obligation was applied to the entity, which amounts to 312 million lek. Together with the initial obligation, the total bill that the company is charged to pay is 468 million lek or 5.15 million euros.
The entity's representatives have refused to sign the minutes, claiming in their administrative complaints that the customs procedures are invalid since the goods were covered by the framework agreement that Albania has with NATO. But this claim has been rejected by the Customs./Kapitali.al
