SPAK's investigative file for the 700 thousand euro KESH tender clearly reveals one of the most used mechanisms in the theft of public money in Albania; that of manipulating the limit fund.

Albanian law obliges contracting institutions, before setting the funding limit for a tender, to conduct a market assessment by receiving preliminary offers from several companies, in order to derive an average of how much the product or service being procured costs.

But often, this entire process is fictitious, as the pre-bids that determine the limit fund are controlled by one hand, as SPAK has proven in the tender for which it has named the former director of KESH, Benet Beci , as a defendant .

farce

A day after Adela Ruko and Ervis Berberi sent the special tender criteria to Dritan Dakolir, the latter started working on making available the emails of the companies to which KESH should send the invitation to make the pre-bid in order to determine the limit fund.

On December 13, Dritan Dakoli forwarded the message "[email protected] [email protected] [email protected]" to citizen Evis Berberi, i.e. the three addresses of the companies that KESH should have contacted to request the preliminary offer.

The Euronet company was owned by Dritan Dakoli himself.

Meanwhile, the other two companies, TMC and Qplan, are owned by Arben Memo , the latter of whom is also a professor at the University of Tirana.

Immediately after receiving the email addresses from Dakoli, Evis Berberi forwarded them to his wife, Adela Ruko, who held the position of Head of the Procurement Sector at KESH.

The latter initially had difficulty finding the correct NIPT of the Euronet company, as several companies with that name appeared. So she asked her husband to clarify.

At 1:38 PM, Ruko writes a text message to Evis Berberi, "Give me the nephew of that second one because there are several in the Central Bank."

Evis Berberi wrote to Dritan Dakol the message "Euronet has just announced that some people will appear in the National Council of Kosovo."

Then Dakoli sent Berberi's GRANDFATHER of his Euronet, and the latter sent him to Ruko.

After NIPTI's clarification, Ruko immediately sent the official invitation for pre-bids to the three companies, which Dakoli had initiated. The latter, after receiving the invitations, wrote to Berber to clarify whether the limit fund would be the average value of the offers that the three companies would make.

How much does the limit fund cost?

At 14:02 Dritan Dakoli writes again to Evis Berberi: "The offers came. We need to find the average of the division by 3?"

Then Evis Berberi replies "One minute".

At 15:25 Dritan Dakoli again writes the message "Do we have time for Monday or not, or should we do it today?" and citizen Evis Berberi replied "On Monday", citizen Dritan Dakoli replies "OK".

At 15:25, Evis Berberi wrote to his wife, Adela Ruko, "How much do you want the fund's average?"

At 15:26, Dritan Dakoli wrote a message to Evis Berberi,  "Give me the code when you get it, please,"  and citizen Evis Berberi replied, "Absolutely."

At 19:46, Evis Berberi wrote a message to citizen Dritan Dakoli "69.5 ml new lek without VAT ", while citizen Dritan Dakoli replied "OK".

After receiving the figure for how much the limit fund should be, Dakoli compiled three fictitious offers so that their average would correspond to the figure of 69.5 million lek excluding VAT, as Berberi told him.

On the same date, the 13th, the Director of Procurement of KESH sha, Valentina Kazanxhi , ordered the establishment of a group to calculate the contract value, for the procurement procedure with the subject: " Strategic Development of the Energy Sector (Research Project) ".

In the circumstances investigated by SPAK, it results that the working group of the Contracting Authority, KESH sh.a., sent an invitation to bid to the economic operators proposed by citizen Dritan Dakoli. For communications with them, the email addresses of these companies were forwarded, through citizen Evis Berberi, to the latter's wife, Adela Ruko, who was the Head of the Procurement Sector at KESH sh.a.

At the same time, Ruko later turns out to be a member of the KVO during the process of evaluating economic operators participating in this procedure.

After the tender, which was won by Ervis Myftari's Consulting & Management Albania Shpk, was announced on January 24, 2020, Adela Ruko sent a message to Ervis Berberi:

"Tell them to bring the documents and contract insurance today, those from Harvard."

The barber replied:

"OK, they'll come."

At 08:50, Ervis Berberi forwarded this message to Dritan Dakol, who responded:

“Hahaha, us Harvard kids. OK, sure. Bro, give me a contact number.”/ Kapital
