The European Commission report was overwhelmingly approved to vote in the EP Foreign Committee. Amid its key findings, it is noted that the country has met all criteria for setting a date for the start of negotiations. But among the key findings, it also reflects the problems.
As far as political criterion is concerned, the EC refers to the OSCE/ODIHR final report, where it is said that the 25 April elections were generally well organised and the role of the electoral administration is assessed. However, the concern relates to misuse of funds and misuse of public administration.
Concerns remained linked, the EC says, to misuse of public resources or official functions, to claims of vote buying and the flow of sensitive personal data covering citizens' political preferences. Mazhorance and the opposition will need to improve political dialogue and work together with all parts of society to further advance the EU reform agenda and membership negotiations. Coordination within the administration must be improved, especially in relation to EU integration.
Territorial administrative reform must be consolidated, the report follows, as part of the broader decentralisation agenda. This is particularly necessary to guarantee local fiscal autonomy and empower municipalities to provide quality public services. Limited progress has been made in implementing the guide to creating an environment conducive to civil society. However, Albanian civil society has been able to provide support and services to the most vulnerable people affected by the COVID-19 pandemic.
The report says Albania is on average prepared for reform in public administration. Some progress has been made in capacity building at line ministries for implementing regulatory impact assessments, adopting guidelines for public consultations, establishing IT systems for integrated planning, increasing the scale of implementation of the National European Integration Plan.
Albania's judicial system is also on average prepared according to the Commission's assessment. Albania has continued to implement comprehensive justice reform, resulting in good progress. The Constitutional Court has begun to fully exercise its functions, including judging constitutional disputes between state institutions for relevant powers. Progress has continued in Appointments to the Supreme Court.
The temporary reassessment of all judges and prosecutors (the process of the trial) has advanced steadily, continuing to produce tangible results - a condition for holding the first intergovernmental conference.
Under the care of the European Commission, The International Monitoring Operation has continued to oversee the process. By September 15, 2021, the institutions had completed 437 first-degree cases, including all priority files. Of the 437 decisions, 298 are of cut form (d.m.th. after complaint). Overall, 62% of the files processed so far have resulted in dismissals and holidays mainly due to resignations from the valued. The institutions are expected to refer to prosecutorial bodies all cases where there are indications of criminal acts.
The Specialised Structure for Anti-Corruption and Organised Crime (SPAK), consisting of the Special Prosecution and the National Bureau of Investigation, are functional. While the 2021 budget foresees the appointment of 20 prosecutors, SPAK has achieved the first target of 15 prosecutors, including the chief special prosecutor.
As far as the fight against corruption is concerned, the report assesses several investigations undertaken over the past year, while calling for this war to escalate and further strengthen the proactive investigation of the files. For the fight against organised crime, even here the level of preparation is considered modest, while co-operation with international law enforcement agencies is assessed.
According to the report, financial investigations must systematically accompany criminal proceedings. Efforts to increase the number of prosecutions and final sentences, especially at high levels, must continue.
