The Competition Authority is not raising the fines it imposes on its own

The Competition Authority has been accused of failing to act, or acting little against companies that have abused the positions of monopolies, or oligopolies in the market by determining the prices of products they sell.

Cases and reports of fictitious price increases are countless and wide-ranging, from pharmaceutical products, to chemical waste for agriculture.

But even in cases where the Authority has intervened with fines, where under the law it can impose up to 10 percent of the annual turnover of subjects caught in violation, the fine is not harvested... At least in the last three years.

According to Euronews Albania, all penalties imposed by competition in the last three years are being challenged by companies punished in the courts. There are 20 indictments in total, six of which have been accepted by the court and the others have been dropped.

In the group of 14 companies, to which the court has refused the indictment, one part has decided to appeal the first-degree decision, while the rest have not yet paid the fine.

The last year competition has won a case on appeal is 2019.

The only mechanism for the Competition Authority to set rules for the functioning of the free market is to fine companies that abuse the dominant position and deform competition.

Pharmaceutical market companies were long ago punished for raising the price of medicines, masks and disinfectants during the pandemic, while they were recently punished with the record fine of 1.5ml euros three chemical garbage market companies. But all these measures have been complained to the courts.
