The KLA does not defend itself with Facebook statuses

The KLA does not defend itself with Facebook statuses
Hashim Thaçi, Jakup Krasniqi, Kadri Veseli and Rexhep Selimi

After the Hague verdict on Hashim Thaçi, Jakup Krasniqi, Kadri Veseli and Rexhep Selimi, Albanian Facebook immediately went into combat readiness. KLA photos, flags, eagles, maps of Kosovo and all those big words that, in such cases, Facebook produces faster than a military headquarters produces orders were taken out of the warehouses.

Within hours, status battalions, profile brigades, and comment divisions were created. Each took his own position. One changed his profile picture. Another put up the KLA emblem. A third wrote in large letters that history is not judged. A fourth declared a traitor anyone who had not yet made a post. Patriotism, as usual, began to be measured by the size of the posters.

The Prime Minister of Albania set the example first. He immediately changed the decor of his Facebook. On the cover he placed the double-headed eagle, while in the post he showed Europe surrounded by barbed wire, as a sign that Europe was already under the clutches of Nazism. Above he wrote a single word, in red letters: TAKEN. After the Prime Minister, a large group of ministers filled their profiles with curses for the Kosovo Specialist Chambers in The Hague that gave the decision they did!

Even the opposition leader Sali Berisha could not be left behind. With his posts, he not only showed that he had predicted this decision several years ago, but also found the opportunity to tell Edi Rama that he was "shedding crocodile tears."

And so Albanian diplomacy did its job. The Foreign Ministry could continue its usual work, the experts could remain calm and the lawyers not worry. The eagle was placed in a combat position, Europe received the reprimand and the Facebook algorithm was officially notified of the position of the Republic of Albania.

The only problem is that the Court of Appeal in The Hague doesn't have a Like button.

The September 16 decision is a first-instance decision. The court found them guilty of war crimes, but not of crimes against humanity, because it did not consider the existence of a widespread or systematic attack against a civilian population to have been proven beyond reasonable doubt.

This is the legal reality. We don't like it. We consider the decision wrong, unfair, exaggerated, or not properly supported by evidence. But unfortunately for digital patriotism, these considerations must now be transformed into legal arguments.

Because the appeal will not open Facebook to see how many Albanians put up the KLA emblem yesterday. It will not count the flags in Pristina. It will not check how many politicians in Tirana said “shame”. It will not even measure who wrote “GET IT” in the biggest letters.

Apeli do të hapë aktgjykimin.

As bllokimi i institucioneve nuk e ndihmon këtë punë.

Jo i vetes. I të tjerëve. Ky është patriot. Ky tjetri është tradhtar. Ky e do UÇK-në. Ai tjetri nuk e do. Ky postoi fotografinë. Ai heshti. Ky tha “turp”.

We are convinced that the sentences are excessive. But it is not enough to state our belief. This must be shown in court with analogous cases. If a piece of evidence was taken wrongly, it must be proven from the file.

If the responsibility of one of them is not properly linked to a crime, the decision should be made there.

This is not as romantic as a rally. It is not as photogenic as a flag. It does not generate as much applause from supporters and political militants who are eager to brush your tail.

But only this work without shouting, with documents and evidence, with expertise and papers, only this can change the decision.

It is too late today to discuss why the Special Court was created, who voted for it, who exerted pressure, who made mistakes then and who is trying to wash their hands of it today. There is material for years of television broadcasts. But that is another story.

The story that Thaçi, Veseli, Krasniqi and Selimi are facing today is called an appeal. And for this, we do not need another war on Facebook, nor a new war between parties in Pristina. We need good lawyers, good experts and institutions that do their job.

Facebook can continue its mobilization in the meantime. There are flags galore, eagles galore, and endless reserves of the word "traitor."
