Lawsuit against construction of 4 HECs in Vlora

The organisation "EcoAlbania" and a group of residents of the village of Brataj of Vlora have filed a lawsuit in the administrative court against the construction of four planned hydropower plants on the Shusha River, which is the main branch of the Vlora River.

"The contract signed in September 2017, envisions the construction of the cascade with installed power of about 15 MW, a minimum contributor to the national energy need", Wrote on social networks EcoAlbania after announcing the lawsuit against the launch of works by the firm "Shushica Hydropower".

According to the organization, these constructions threaten the area's rich ecosystem, where among other things there are species listed on the red list of extinction birds. In addition, HECs also touch on a first-category culture monome, such as the Brataj Bridge, which has received this status since 1973.

According to Citizens-Channel, there are numerous violations in the approval of environmental permits for these HECs. In 2017, the company "Shushica Hydropower" received environmental permission to build the four hydropower plants over Shushica. In 2020, the company completed the deadline for starting fieldwork, so it underwent procedures again.

"Shushica Hydropower" has already resumed legal proceedings, holding another public hearing in November 2021 in the village of Lepenica. The public hearing is one of the legal arguments where representative lawyers Dorian Matlija and Irena Dule argue there are violations.

"At the hearing held in a private bar in Lepenica on 04.11.2021, only 5 inhabitants of this village were present, 3 of whom from the same family and none of them were inhabitants of Brataj, which is also the centre of the administrative unit", the indictment states.

It is also argued that the preliminary Environmental Impact Assessment has not been published on the National Environment Agency page, which is a legal obligation. Similarly, in the National General Plan (PPK), as the highest territory planning instrument in Albania, no hydropower construction is provided for over the Shusha River.

The Selenica Municipality's Local General Plan (PPV), in all its contents, introduces the strategy of developing the Vlora River (Shusica) as well as the entire area towards tourism and agro-tourism.

The lawsuit states that the National Environment Agency has already approved the Permission without Deepened Assessment in the Environment (VNM), avoiding the deepened study of negative effects on the environment from the construction of four HECs. Earlier, in 2018, this Agency had estimated that the construction of 4 HECs on the Shusha River should be passed in the process of the deepened VNM.

Through this lawsuit, the suspension of the implementation of the contract between the Ministry of Energy and Infrastructure and the company "Shushica Hydropower" is required until the final settlement by decision of the cut form and the abolition of the decision to approve the preliminary VNM.
