ISP: The mandate of the Ombudsman has been over for 5 months, the Assembly is
People's Advocate

The Institute of Political Studies, through a response, declares that after 5 months after the expiration of the constitutional deadline, the Assembly has not yet fulfilled its constitutional and legal obligation, in terms of the mandate of the People's Advocate.

According to ISP, such delays and vacancies are a critical indicator of the role of the Assembly and its legal responsibilities, as well as an indicator of double standards in decision-making.

In the reaction, it is said that the Assembly is violating the law in this case, as it has not ensured the procedures of competition and voting for the new leader.

Feedback:

In May 2017, the constitutional mandate of the People's Advocate expired, an important function in the protection of human rights and public interests. The Assembly should have ensured all the procedures of competition and voting for the new leader or the confirmation of the old leader, - but the Assembly, mainly due to personal and political lobbying, first postponed the legal deadlines for the competition and then did not still managed to make a decision. In October 2022, i.e. 5 months after the expiration of the constitutional term, the Assembly has not yet fulfilled its constitutional and legal obligation.

Such practices of delays and vacancies are a critical indicator of the role of the Assembly and its legal responsibilities, as well as an indicator of double standards of decision-making: every citizen of RSH is penalized administratively if he exceeds the daily deadline of obligations, every private entity is also penalized , but when the main decision-making institution, the Assembly, violates the law, there is neither penalty, nor responsibility, nor apology, nor reflection. Such contrasts are typical of fragile and pyramidal democracies, where personal influences and political preferences ignore democratic and legal procedures and norms.

Time for transparency and accountability.
