The Democratic Party has complained to KAS about the registration of the SP candidate for the Mallakstër Municipality, Qerim Ismailaj.
The latter was sentenced to 6 months in prison in February of this year by the Special Court Against Corruption and Organized Crime, found guilty of falsifying documents, because he had hidden in the decriminalization form a 3-year sentence in Greece for acts of violence .
"Based on the above legal provisions, it results that the legal situation of citizen Qerim Ismail Ismailaj falls under the conditions of detention provided for in law no. 138/2015, "On guaranteeing the integrity of persons who are elected, appointed or exercise public functions" and more specifically of its articles 2 and 4 because: (i) by Decision No. 11 of 02.02.2023 of GJKKO the defendant Qerim Ismailaj was sentenced by a final decision to 6 months imprisonment according to point 1 of this decision for the criminal offense "Forgery of seals, stamps or forms" provided by article 190, first paragraph of the Criminal Code. As can be seen from the court's decision, this crime is committed only intentionally, and under these conditions, this citizen is prohibited from running for office; (ii) the judicial decision was given by an Albanian authority; (iii) the decision is of a final form starting from March 29, 2023; (iv) the rehabilitation period of 2 years has not been exhausted and according to the law expires on March 29, 2025.", it is said in the DP complaint.
Meanwhile, earlier the democratic deputy Gazment Bardhi sent an official letter to the CEC and asked him to stop the re-candidacy for the May 14 elections of the mayor of Mallakastra. According to Bardhi, Qerim Ismailaj was convicted by the Special Court for forgery.
The State Commissioner of Elections, after his own verifications, came to the conclusion that the candidate Qerim Ismailaj does not appear to have any obstacles for his candidacy for the Municipality of Mallakastra. But, Bardhi said that the candidate of the Socialist Party is under the conditions of the ban to re-candidate, as the Special Court has sentenced him to six months in prison. Then the past judgment was accepted and 1/3 of the sentence was reduced.
