Parliamentary committees have begun discussions on amending the law that determines the salaries of judges and prosecutors, following the Constitutional Court's decision in February of this year, which repealed the method adopted in 2023.

But how did the conflict between the government and the judiciary over their level arise? Until 2023, the reference salary for judges and prosecutors was equal to that of department directors in the Prime Minister's Office.

The reference salary was increased by 90 percent for first-instance judges and prosecutors, 98 percent for those of appeal, and 106 percent for SPAK magistrates and prosecutors of the General Prosecutor's Office.

For example, according to this formula, if a department head in the Prime Minister's Office was paid 100 thousand lek, the same was the salary of judges and prosecutors. To this salary was then added 90 thousand lek for first instance magistrates, 98 thousand lek for those of appeal, and 106 thousand lek for magistrates of SPAK and the General Prosecutor's Office.

In 2023, the salary reform in the administration also affected the salaries of heads of government departments. Their salaries went to 220 thousand old lekë. If this level were to remain the reference for the salaries of judges and prosecutors, due to the above formula, the income of magistrates would increase more than fourfold.

But the Assembly intervened by changing the reference. In 2023, the law decided that the reference salary for magistrates would be 36 percent of the President's salary. The current salary of the President is 425 thousand lek, which means that the reference salary for judges and prosecutors is somewhere around 153 thousand lek. This figure is added to by an allowance of 90 to 106 percent according to the categories of magistrates, which means that their salaries range from 250 thousand to 310 thousand lek.

The increase is increased by 2 percent for each year of work, but not more than 25 years, and indexed according to the annual inflation rate determined by the Bank of Albania. However, this formula was overturned by the Constitutional Court and the Socialist Party has filed amendments through MPs Aulona Bylykbashi and Admir Kadeli.

The two deputies propose a reference salary of 38 percent of the President's salary, or about 161 thousand lek, while not affecting the levels of allowances for magistrates at the three levels of the judiciary, but increasing from 60 to 80 percent the payments for work difficulties for SPAK judges and prosecutors.
