Tenders, businesses complain: Over 97 percent are for procedures above the high

Tenders above the high monetary limit register the most frequent complaints from economic operators at the Public Procurement Commission. According to the data from this department, it turns out that during this year 781 complaints were filed for these types of procedures, or over 97% of the total of 803 complaints filed so far.

According to the legislation in force, these procedures include tenders over ALL 650 million for public works contracts and ALL 40 million for public goods and services contracts. Meanwhile, if we divide them according to the type of contracts, the complaints are dominated by goods, with a total of 505 complaints. After them are services with 221 complaints and public works with 55 complaints.

Meanwhile, public procurement procedures dominate the number of complaints with 791, while other complaints include auctions, mining permits and tenders in the field of defense and security, with a total of 12 complaints. Regarding the concessions, during 2023 no complaint was filed.

Mainly, the economic operators object to the Public Procurement Commission's decisions of the bid evaluation commissions, where the change of these decisions is usually requested. Meanwhile, the rest is occupied by complaints about the tender documents, where contracting entities are often accused of discriminatory and exclusionary criteria.
