The government has approved changes to the law on public procurement, where according to the proposal that must be approved by the Assembly, the state authorities that organize tenders can delegate these powers to private companies.
In the draft law, one of the points defines that the procurement service provider is a public or private entity, domestic or foreign, that offers auxiliary activities for public procurement".

This means that a state institution that has published a procurement procedure may not engage directly in the development of the tender, but assign this responsibility to private companies, against a fee that the parties agree on beforehand.

The fee for performing auxiliary activities for public procurement will be up to 1 percent of the estimated value of the contract to be procured. As an example, if it is a tender of 100 million euros, the private company that will carry out its procedures on behalf of the state can benefit up to 1 million euros fee.

Another point that changes in the law is that for small institutions or those that have less than 15 employees whose tenders, if they are not small purchases, are developed by the superior authorities.

The draft proposed by the Council of Ministers also abolishes the "Consultancy Service" type of procurement procedure, while it also provides for the possibility that the Ministry responsible for finance proposes the establishment of a remuneration measure for the employees of the contracting authorities or entities involved in the procurement process.
