Amnesty International Italy has stated that it is deeply concerned about the protocol's potential negative impact on the effective protection of human rights and invites Italian institutions to abstain from ratifying and implementing the migrant agreement between Italy and Albania.
"The implementation of the protocol will have countless negative consequences on human rights. In particular, for the search and rescue system at sea, for the right to asylum and for procedural guarantees to protect people in vulnerable conditions, as well as for the personal freedom of asylum seekers and migrants," said Anneliese Baldaccini, institutional relations manager at Amnesty International Italy.
The draft law ratifying the Italy-Albania protocol on strengthening cooperation on migration issues is at the heart of a debate in Italy that concerns several critical points.
The international obligation to ensure swift landing in a safe place after the rescue is clearly broken by the choice to impose a long journey from the central Mediterranean to Albania (about 1000 km). This unnecessary extension of travel, in addition to being a violation of international search and rescue standards, brings additional suffering to people who have just been rescued from the sea, often traumatised by other people drowning or in need of urgent assistance. Furthermore, the agreement could have further negative impacts on the search-and-rescue system, worsening the already critical situation in the central Mediterranean and putting many lives at risk. In 2023 alone, at least 2,498 people lost their lives at sea in the central Mediterranean, marking a marked increase compared to the previous year.
"In European and international law, detention is an exception that requires individual assessments and cannot constitute a rule. The Italian-Albanian Memorandum of Understanding ignores this principle, envisages the automatic detention of all persons brought to centres in Albania, including asylum seekers. In doing so, we show how the application of expedited 'border' procedures for the evaluation of asylum claims actually favours the mass use of administrative detention," said Anneliese Baldaccini.
The combined implementation of the Italy-Albania agreement and the recent changes introduced in national legislation would allow the detention of a person who landed in Albania for a continuous period of over 18 months. Automatic and prolonged detention are both inherently arbitrary and therefore unlawful. A bilateral protocol is not enough to erase a basic principle of law, under which personal liberty must be the default position and detention exception. Seeking asylum is not a crime," Baldaccini added.
