During the past year, 471 lawsuits were filed in the courts for the issues of property restitution and compensation.

Now with the entry into force of the new decisions on these issues, all those subjects who have addressed the courts have the right to waive the judgment of the case and submit a request to the Property Handling Agency.

For former owners restitution will be physical without limitation with the claimed land if it is free, or in cash. There will no longer be a financial assessment of less than 10 percent according to the current cadastral item, the compensation amount will be indexed until the final payment.

With the legal and by-law changes, which came within the framework of the recommendations given by the European Court for Human Rights, for those previously unhandled files, the Property Handling Agency has announced that it will begin administrative proceedings.

The Agency informs that at the end of the deadline for Handling Requests for Ownership Recognition, it has notified the interested entities to withdraw the filed documentation in order to start with the procedures at the Court of First Instance for 6950 unhandled requests.

For the process of property return and compensation, the new decisions foresee an order of priority, financial compensation is the last. Two types of forms of physical compensation are preferred.

The financial assessment made so far for about 20 thousand requests reaches the value of 101 billion Lek./Tv Klan
