Court overturns Alves' conviction, footballer innocent of sexual assault

The High Court of Justice of Catalonia has accepted the appeal of former footballer Dani Alves against his four and a half years in prison sentence for sexually assaulting a woman in a nightclub in Barcelona.

The court overturned the conviction, stating that there was insufficient evidence to "overcome the standards required by the presumption of innocence." The decision, announced on Friday, means the footballer's acquittal but can be appealed.

Alves was found guilty in February 2024 of raping a woman in a nightclub in December 2022 and was sentenced to four and a half years in prison.

The former Brazil and Barcelona star was released from prison in March 2024, while he waited for his appeal to be heard by a higher court.

In February 2024, the Barcelona Court sentenced Alves to four and a half years in prison, five years of post-release supervision and a nine-year ban on approaching the "victim."

He was also ordered to pay compensation of 150,000 euros to the victim.

In its decision, the appeals chamber of the High Court of Justice of Catalonia, composed of three women and one man, considered that the testimony of the "victim" was not "sufficient to uphold the conviction of the accused" and that in this case the right to the presumption of innocence prevails, as reported by "Cadena SER".
