The Chairman of the Democratic Party Parliamentary Group, Gazment Bardhi, has issued strong accusations against four members of the Constitutional Court, whom he considers to have acted politically in defense of Prime Minister Edi Rama, by rejecting the parliamentary investigation into the "McGonigal" case.

In a lengthy reaction on the reasoning of decision no. 62/2026 of the Constitutional Court, Bardhi states that the constitutional body has used different standards for the two opposition requests, accepting the parliamentary investigation into the May 11 elections, but rejecting the request to establish an investigative commission on the "McGonigal" case.

According to him, the four constitutional judges – chairwoman Fiona Papajorgji and members Sonila Bejtja, Sandër Beci and Ilir Toska – have constructed arguments that, according to Bardhi, were not even used by the parliamentary majority to justify the rejection of the request.

"The constitutional duty of the judges of the Constitutional Court is not to invent arguments to 'save' Edi Rama. Their duty is to control the constitutionality of the arguments presented by the parliamentary majority," Bardhi says.

He goes even further, stating that the four judges have entered a political race to protect the Prime Minister.

"It is a great courage that what even Taulant Balla cannot invent to protect Edi Rama, constitutional judges Fiona Papajorgji, Sonila Bejtja, Sandër Beci and Ilir Toska invent. Their task is not to compete with Taulant Balla as to who protects Edi Rama the most, but to provide constitutional justice," he writes.

Bardhi argues that the opposition's request clearly identified the subject and object of the parliamentary investigation, claiming that the document described the actions that were sought to be investigated in relation to the "McGonigal" affair, including meetings, suspected favoritism, and alleged interference in the hydrocarbons sector.

At the end of the reaction, the head of the DP parliamentary group declares that, although he considers the Constitutional Court's decision "insulting and unacceptable", the opposition will respect it and will reformulate the request for the establishment of the Investigative Commission, submitting it again to the Assembly.

According to Bardhi, if the request is rejected even after this, then the impression would be created that a new principle has been consolidated in the practice of the Constitutional Court: "Edi Rama is untouchable."
