Today, the Special Court of Appeal for Corruption and Organized Crime sentenced former MP Artur Roshi for defamation with a fine of 500,000 ALL.

In addition, the former deputy was punished by GJKKO for insult with a fine of 500,000 ALL.

As a result of combining the punishments, GJKKO set a single punishment for the former deputy in the amount of 800,000 (eight hundred thousand) ALL fine, which is to be paid in installments of 25,000 (twenty-five thousand) ALL per month on the deadline 32 (thirty-two ) months.

Court costs in the amount of 245,700 (two hundred and forty five thousand and seven hundred) ALL are charged to the accused AR

The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Dhimitër Lara (chairman), Nertina Kosova (member) and Daniela Shirka (member), today on 13.10.2022, completed the examination of the registered case with no. Act 51, dated 13.07.2022, on the appeals submitted by the appellant/accused AR as well as by the appellant/accusing victim AC, against decision no. 16, dated 01.03.2022 of the Special Court of First Instance for Corruption and Organized Crime which has decided:
"1. The not guilty declaration of the accused AR, for the criminal offense "Insult", provided for by Article 119/2 of the Criminal Code, related to the publication on his Facebook profile dated 17.05.2020, as the fact is not provided by law as a criminal offense.
2. The guilty plea of ​​the accused AR for the criminal offense "Defamation", provided for by Article 120/1 of the Criminal Code, to the detriment of the accusing victim AC, in connection with the e-mail dated 19.05.2020, sent to the address of Central Directorate of {...} Bank, and his punishment with a fine of 50,000 (fifty thousand) ALL.
3. Court expenses charged to the accused...".

In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:

– Lënien në fuqi të vendimit nr. 16, datë 01.03.2022 të Gjykatës së Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar përsa i përket deklarimit fajtor të të akuzuarit A.R., për veprën penale të “Shpifjes”, parashikuar nga paragrafi 1 i nenit 120 të Kodit Penal.
– Ndryshimin e vendimit si vijon:
– Dënimin e të akuzuarit A.R. për veprën penale “Shpifje”, sipas paragrafit 1 i nenit 120 të Kodit Penal dhe dënimin me 500.000 (pesëqind mijë) lekë gjobë.
– Deklarimin fajtor të të akuzuarit A.R., për veprën penale “Fyerja”, sipas paragrafit 2 të nenit 119 të Kodit Penal dhe dënimin me 500.000 (pesëqind mijë) lekë gjobë.
