The way of taxation for construction permits and infrastructure impact tax is almost the same in Kamza Municipality and Tirana. What changes is the amount builders have to pay, which is significantly smaller in Kamza.

This seems to be the big reason why Samir Mane has lobbied in the Government and given himself the powers of a decision-makers by changing the territorial map and through a questionable legal decision has stripped part of the territory of the Municipality of Tirana, to pass to the Kamza Municipality.

It's about where Mane is building the "Universe City Residence" residential complex. According to the territorial division with the 2015 law and a decision of the December Council of Ministers of that same year, this country was part of the Municipality of Tirana and the Kashar administrative unit, thus under the territorial jurisdiction of the Municipality of Tirana.

Despite the law in force of 2015, which divides the territory into 61 municipalities and VKM number 1078 dated December 23, 2015, the map of kamza Municipality has been extended as a pocket in the realm of Samir Manes with the number 5126/3 match, dated 21 November 2020 that has handed over to the Agency for the Support of Local Self-Government The Secretary General of the Council of Ministers, Angel Agachi.

The reason for this change seems to be taxes. Why? For a building permit, or infrastructure impact tax, tirana Municipality applies significantly higher fees than Kamza's. As an example, construction permission in Kamza is 1 percent and the impact tax on infrastructure, according to a December 2019 decision of the Kamza Municipal Council, is 4 percent. The first is estimated in the value of investment, while the second in the value of the sale for each meter/square area of exploitation.

Meanwhile, in the Municipality of Tirana, according to decision No. 158, dated 26.12.2019 of the Municipal Council, construction permission is also 1 percent of the value of investment, but what makes the difference is the impact tax on infrastructure. According to point 2 of Article 23 of the Tirana Municipal Council decision, this tax is 8 per cent of the sale price per metre/square.

The basis of the infrastructure impact tax, both for Kamza and Tirana, is the value per square metre of the sale price of constructions for residential purposes, or of trading and service units. The sale price per metre/square is based on market value reference prices, according to the definitions issued by act of the Council of Ministers.

The last act of determining reference prices by the Government is 2019, where for the Area of Kashar it is about 500 euros per metre/square, while in The Snare about 450 euros per metre/square per area of exploitation.

As seen by these figures, the reference price per meter/square does not have enough margin to invest Samir Manen who lobbies in the government and illegally changes the administrative map of the country and for the estimation effect we are taking as if it is 500 euros in both kamza Municipality and Tirana for this area.

In this case, the lapsi that has changed the dividing coordinates between the two municipalities has saved Samir Manes several millions of good thanks to avoiding the 8 per cent impact tax on infrastructure he would have to pay if he were part of Tirana.

As an example, for a square metre to be used in the "Universe City Residence", Samir Mane will pay 4 percent of the reference price for every meter used in kamza City Hall, or about 20 euros in infrastructure impact tax.

But if construction were in the Municipality of Tirana, the tax would be twice as high, i.e. 40 euros per metre, always considering that the reference price is the same, i.e. 500 euros per metre/square, although in The Sandstone it is lower than that. So, for every meter/square construction and exploitation that stripped the Municipality of Tirana, Samir Mane has avoided the state with 20 euros in taxes through this anti-legal maneuver.

Total? An accurate figure at this stage, which is the construction of residences, is difficult to estimate, but a rough estimate can be made based on project data. According to this data, in total there will be about 20 residential buildings with 7, 8 and 9 floors and one floor underground.

The total construction area is not given to the public data of the project, but is given the total area of underground parking lots, according to which it is about 90 thousand meters/square. If we divide this figure by 20, the minimum number of buildings expected to be built, according to the project, one floor will have an area of about 4500 meters/square. This figure is multiplied by the average floor of buildings, i.e. 8. The result: a building will have about 36,000 square meters/square of residential area in total.

Në Bashkinë e Kamzës, Samir Mane do të paguajë rreth 720 mijë euro si taksë ndikimi në infrastrukturë për çdo godinë që do të ngrejë në këtë zonë. Nëse kjo taksë do të mblidhej nga Bashkia e Tiranës, shifra do të ishte dy herë më e lartë, pra rreth 1.44 mln euro për çdo godinë të ndërtuar.

Nga projekti i prezantuar e që ka nisur të reklamohet prej muajsh tashmë, kuptohet që numri i godinave do të jetë të paktën 20 të tilla. Në total, me nivelet aktuale të taksës së ndikimit në infrastrukturë Samir Mane do të paguajë rreth 14 mln euro te Bashkia e Kamzës dhe nëse taksa do të paguhej te Bashkia e Tiranës, taksa do të ishte dyfish, pra rreth 28 mln euro. Pra, me një laps mbi hartën administrative, Samir Mane kurseu 14 mln euro.

Nëse kjo aferë nuk është për SPAK...atëherë nuk dimë se për çfarë tjetër shërben Prokuroria e Posaçme.
