Charges have been filed in Albania concerning several armed forces properties by former Naval Forces Leader Arthur Mechollari. In two indictments filed by him with the Special Prosecutor, it is said that officials and former senior officials of the Ministry of Defence and the army have abused office. He says they have allowed interference in several separate properties for which the President's approval should be received earlier. America's voice confronted his claims with those of state institutions and brought the following material.

The Special Prosecution Against Corruption and Organised Crime in Albania has opened preliminary investigations into two criminal escalations made in March and April 2021 by Arthur Mechollari, former senior head of the naval force. These include current and former senior officials of the Ministry of Defence, Army General Staff, Naval Force and Military Police. In an interview for Voice of America, Mr. Mechollari accuses them of having abused duty in connection with two private activities allowed on properties in the Deployment and Proliferation Plan, as are known areas where naval forces are dislocated. (These properties are part of the Structure and Operational Requirements of the Naval Force) Any change of these properties is made by proposal of the Minister of Defence and approved by the President. Mr. Mechollari, in his two escalations, says the changes to the plan have been made without receiving the President's approval.

"One indictment is for abuse of duty in relation to the lease of the entire Sea Base of Limion Saranda, leaving no square metre for the naval force, and the second is for the Naval Base of St. John, where it is built within the property located in the Naval Force's deployment and spread plan, that is categorically prohibited by law" - Arthur Mechollari, former Commander of the Naval Force, told the Voice of America.

According to Finance and Economy Ministry data on the rental of the naval base in the Gulf of Limion Saranda, it turns out that in decision number 514 of the Council of Ministers, approval is provided for linking the lease contract with 1 euro /contract between the Ministry of Finance and Economy, as a tenant, and the union of "Concord Investment" societies, e.g. and "Kastrati Group", represented by the "Marina Bay Saranda" society, as tenants, for state wealth with a total area of about 265 thousand square meters. Within this territory there is also a property with an area of about 39 thousand square meters numbering 696, which according to Mr. Mechollari, is part of the plan of deployment and spread, for whose lease, the approval of the President of the Republic must be received beforehand. In the draft contract that Voice of America secured through the Ministry of Finance and Economy, in addition to exercising action in the field of tourism for 20 years, it is also envisaged the construction by the tenant society, of a bank for naval forces in the Gulf of Limion in Saranda. Former Senior Naval Force Leader Arthur Mechollari says that at the time he was still in office, there had been a naval force proposal on the issue of the base but was not taken into consideration.

"Since the contractor side proposed the construction of a new "pro buono" base for the armed forces, then and the naval forces demanded that it be built smaller on the surface than the current one and the rest to be rented. But this was certainly why the President of the Republic had to pass for approval in the quality of the Commander-in-Chief of the Armed Forces. VKM No. 54 cannot be a legal basis for renting the area of 39,446 square metres, part of the deployment and spread plan" - Arthur Mechollari, former Vice Commander of the Naval Force, told the Voice of America.

In response to The Voice of America's interest with the President of the Republic, regarding the leasing of this army property, it is said that "the Institution of the President of the Republic, has not received any request from Defence Minstria for the expropriation of the FA's deployment and spread of property No. 696 (Ndihmuesea Base, Limion, Saranda)". According to the Presidency office, this property with an area of 39,446 m² is within the FA's deployment and spread plan.

Concern is raised in the President's response to the "property situation within the FA's deployment and spread plan, as well as their changed status contrary to the law".

The Voice of America was addressed to the Ministry of Defence, regarding the legal basis of the lease of property No. 696 with an area of about 39 thousand square meters, in the Gulf of Limion in Saranda. In the official response it is said to have been leased based on a decision of the Council of Ministers No. 54, 2014 that sets out criteria and procedures for the rental of state assets.

The Defence Ministry further clarifies, "that the leasing of the naval base in Limion Saranda is based on the above KM decision, as in the Law where the President is based on the adoption of the spread plan, the procedures for leasing state property in the administration of the Ministry of Defence are not provided for".

From the two responses, the Ministry of Defence and the President of the Republic are based on two different legal acts for renting property with No. 696, at the Limion naval base in Saranda.

In addition to the case of Limion, former Naval Force Commander Arthur Mechollari, has also filed a second lawsuit with SPAK, concerning the construction of an object, from a private subject, on a Naval Force property, part of the plan to spread to the St. Gen. Naval Base. Mr. Mechollari raises concern about how intensive work was allowed to be carried out for 4 months from November 2020 to March 2021, within a base guarded by armed guards.

"My indictment of The Oblast includes abuse of duty for the leadership of the Armed Forces, Naval Force and Military Police, as in a 4-month period, from November 2020 to March 2021, the construction of a 4-storey object within the Naval Force property has been knowingly allowed in the deployment and spread plan. The law on the return of property compensation prohibits the return of property to the spread plan, which is approved by the President" - said Arthur Mechollari, former Vice Commander of the Naval Force.
