It seems that the Minister of Justice, Ulsi Manja, does not like the right to information law, but censorship. And in order to realize this, the department that he leads has made some changes in the law on the right to information.

In the draft prepared by the Ministry of Justice, the most important point is the reduction of fines received by state institutions, in cases where they do not provide the required information.

According to Article 18 of the current law, if an institution refuses to provide information, the responsible official is fined an amount that starts with 150,000 and reaches up to 300,000 ALL.

While the amended law lowers the lower limit of the fine to 50,000 ALL.

The Ministry of Justice justifies this decrease with the salaries of public servants, which according to it, in some cases are several times smaller than the fine itself.

"In some cases, also applied in practice, the minimum limit of the amount of the fine has turned out to be several times greater than the salary of public servants, and the imposition of such a amount of fine causes considerable damage to economic and social conditions. employee's living. The main goal of administrative punishment is to prevent the violation of the law, as well as to raise the awareness of the offender and not to punish him. For this reason, the measure of the fine has been revised, however, care has been taken to ensure proportionality on the one hand by reducing the minimum limit of the fine and, on the other hand, to guarantee the granting of a proportional penalty in relation to the violation, without changing the maximum limit of the value of the fine", says the report.

The law on the right to information gives every citizen the right to access public information, without having to explain the reasons. Acquaintance with the required information is done through the original document, or by obtaining a copy of it in the form or format that allows full access to the content of the document.

Every person, when he considers that his rights provided by this law have been violated, has the right to complain administratively to the Office of the Commissioner for the Right to Information and Protection of Personal Data. The appeal is made to the Office of the Commissioner for the Right to Information and Protection of Personal Data within 30 working days from the day when: the appellant received notification of the rejection of the information or the deadline stipulated in this law for the provision of information has passed. In case of verification by the Commissioner of the violation of the right to information, direct fines are applied to the head of the institution, the coordinator of the right to information or to any employee responsible for not providing information.
