Death of 3-year-old Brian Spahiu, ANNOUNCEMENT from the Prosecution: Doctor

Prosecutor's Office Announcement:

The minor died after a dental procedure, the Tirana Prosecution Office issues security measures for five people for 'Murder by negligence', 'Fraud in collaboration' and 'Abuse of office'

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, has issued security measures for five people for the criminal offenses of 'Murder by negligence', 'Fraud in collaboration' and 'Abuse of office' in the framework of the investigations into the case of the death of a 3-year-old minor after a dental procedure in a clinic in the capital. The Prosecutor's Office, following the investigations initiated on criminal proceedings no. 6477, dated 05.10.2023, has taken the following citizens into investigation:

1 – R. Xh., for committing the criminal offense “Murder by negligence”, provided for by Article 85 of the Criminal Code as well as for the criminal offense provided for by Article 180/ai of the Criminal Code. Based on the prosecutor's request, the court imposed the security measure “House arrest”, provided for by Article 237 of the Criminal Procedure Code;

2 – I.Xh., suspected of committing the criminal offense of “Murder by negligence”, provided for by Article 85 of the Criminal Code and “Fraud”, committed in collaboration, provided for by Article 143/2 of the Criminal Code;

3- MG, suspected of committing the criminal offense of "Murder by negligence", provided for by Article 85 of the Criminal Code and "Fraud", committed in collaboration, provided for by Article 143/2 of the Criminal Code;

4 – ES, suspected of committing the criminal offense of “Abuse of office”, committed in collaboration, provided for by articles 248 and 25 of the Criminal Code; and

5 – E. A, suspected of committing the criminal offense of "Abuse of office", committed in collaboration, provided for by articles 248 and 25 of the Criminal Code.

The prosecutor requested the security measure 'Arrest in prison' for the persons under investigation I. Xh. and MG, while the court imposed the security measure 'House arrest', as provided for in Article 237 of the Code of Criminal Procedure.

Following the investigations related to the event of 28.09.2023, when the minor BS, aged 3, underwent a dental procedure on 14 teeth, at the "Splendent" Clinic run by doctors R.Xh and I. Xh. After the procedure, the minor returned home and within a few hours was sent in serious health condition (coma and acute respiratory failure), to the Pediatric Hospital at the "Mother Teresa" Hospital Center, Tirana, where he later died on 01.10.2023.

Për shkak të mangësive dhe konkluzionit të paargumentuar në aktin e ekspertimit mjekoligjor të kryer nga ekspertët e I.M.L.-së, nga ana e prokurorit të çështjes Alma Felaj, për një hetim të plotë, të gjithanshem e objektiv të çështjes penale, në datën 10.12.2023, u vendos kryerja e riekspertimit mjekoligjor dhe ekspertimit mjekoligjor shtesë multidisiplinar me grup ekspertësh. Për këtë qëllim u kërkua ndihmë juridike autoriteteve italiane të drejtësisë, duke kërkuar kryerjen e riekspertimit mjekoligjor dhe ekspertimit mjekoligjor shtesë multidisiplinar me grup ekspertësh në shtetin italian.

Sipas aktit të riekspertimit mjekoligjor dhe ekspertimit mjekoligjor shtesë, nga ana e grupit ekspertëve italianë u arrit në konkluzionin se:

Shoku septik i rëndë, që solli më pas insufiçencën progresive shumëorganore, është shkaku kryesor i vdekjes të pacientit të mitur B. S. Grupi i ekspertëve arriti në përfundimin se gjatë ndërhyrjes dentare dhe procedurës së anestezisë, nga ana e anestezistit dhe stomatologeve që kanë trajtuar të miturin, janë konstatuar shkelje të rënda të protokolleve mjekësore ndërkombëtare dhe praktikave më të mira mjekësore, të cilat kanë një lidhje shkakësore të drejtpërdrejtë me vdekjen e tij. Këto shkelje kanë konstatuar në:

– moszbatimin, moskryerjen e kontrolleve dhe verifikimeve të nevojshme për identifikimin e saktë të gjendjes klinike para operacionit të pacientit; mosformulimin në mënyrë adekuate të diagnozës para operacionit dhe mostrajtimin e duhur profilaktik para operacionit dhe në vazhdim, i mituri iu nënshtrua një procedure kirurgjikale pa u vizituar në mënyrë adekuate, pa një diagnozë të saktë, pa një indikacion të arsyetuar, pa specifikuar alternativat dhe pa kryer testet e nevojshme dhe të detyrueshme për gjendjen klinike të pacientit;

– ndërhyrje e kryer, e cila ishte më e gjerë se sa lejohej për një fëmijë të moshës 3 vjeç dhe induksioni i anestezisë së përgjithshme për një periudhë prej rreth 5 orë, për të trajtuar njëkohësisht shumë dhëmbë, mes të cilëve disa me infeksion të pulpës me rreziqet që lidhen me anestezinë e përgjithshme dhe kontrollin e vështirë të infeksioneve postoperative, evidenton përgjegjësinë për overtreatment
– nxjerrjen plotësisht e papërshtatshme nga spitali i të miturit, duke mos marrë parasysh gjithashtu rreziqet që lidhen me anestezinë dhe patologjitë nga të cilat vuante fëmija, e sidomos arsyet për një kohë të zgjatur zgjimi, pas ndërhyrjes si dhe shenja të tjera klinike.

Grupi i ekspertëve italianë ka konstatuar shkelje të rënda të protokolleve mjekësore në kryerjen e autopsisë dhe ekspertizës mjekoligjore, nga ana e ekspertëve të I.M.L.-së, shtetasit E.S dhe E. A.

Gjithashtu grupi i ekspertëve italiane ka konstatuar shkelje të protokolleve mjekësore nga ana e mjekëve reanimatorë të Pediatrisë, të cilët kanë trajtuar të miturin B.S.

Based on this fact, the prosecution has taken as persons under investigation citizens V. H and D. S, doctors in intensive care at the Pediatrics Department at the University Hospital, suspected of committing the criminal offense of "Neglect in medical treatment" provided for in Article 96/1 of the Criminal Code.
