GJKKO's argument for security measures against Balluk: He could repeat the
Belinda Balluku

Vox News has obtained part of the Special Court's decision and the reasoning on the decision to impose security measures on Deputy Prime Minister Belinda Balluku, ARRSH Director Gentian Gjyli, and KESH Administrator Erald Elezi. The GJKKO argues that the three pose a real risk to the investigation.

In the documents provided, the GJKKO emphasizes that there is "a significant reason that jeopardizes the obtaining or authenticity of the evidence", based on the high state functions that the defendants have exercised.

According to the court, their positions as leaders of the institutions under investigation, the Ministry of Infrastructure, ARRSH and KESH, create real opportunities for interference with documents, concealment or destruction of evidence.

The court underlines that the proceeding body is verifying documents administered by institutions that the defendants themselves have directed, which increases the risk of compromising the investigation.

The reasoning states that Balluku, Gjyli and Elezi pose a flight risk, based on the length of the punishment foreseen for the criminal offenses they are suspected of, up to 5 years in prison for one of the referred charges. The court assesses that this factor, combined with the profile and opportunities they have, increases the likelihood that they will evade criminal proceedings.

Also according to point 174 of the decision, the court argues that "due to the circumstances of the fact and the personality of the defendants", there is a risk that they will commit the same criminal offenses for which they are being prosecuted .

In its analysis, the GJKKO notes that the investigation relates to the management of public funds, a process that the defendants have administered themselves and which they could influence again if they are not restrained.

The court declares that the security measures of a preventive nature against Balluk, Gjyli and Elez are “necessary to meet the security needs required by the investigation” . It refers to Article 229 of the Code of Criminal Procedure, emphasizing that the measure must be in proportion to their dangerousness, the importance of the fact and the possible continuation of actions with criminal consequences.

In conclusion, the GJKKO reasons that only coercive measures can guarantee the smooth conduct of investigations, the protection of evidence and the avoidance of any attempt to influence the process.
