SPAK's double standard: awarded a tender without competition to the same
Former General Director of RTSH, Thoma Gëllçi

The show "Inside Story" revealed tonight the double standard of SPAK in the investigations.

It is about a case that made a big fuss, the arrest and conviction of the former general director of RTSH, Thoma Gëllçi.

He was investigated by SPAK and sentenced to one year and 4 months by the Special Court, for a tender for equipment worth 86 million ALL

"But what did Thoma Gëlçi do, which is a matter of what he does, nothing. He did his job, postponed the announcement of the tender for two weeks, without dealing with the tender at all. They took him and killed him inside, and the prison will do him good. He barely saved his head and ran away. Saimir Tahiri did not waste his duty, why did SPAK do this, because he is under pressure, to enter, to create a model. so this is the political pressure, if you want, and the diplomatic one, which for me is where the media pressure they say", says Ylli Manjani.

To this day, Thoma Gëllçi claims innocence. Criminal responsibility is one side of the coin of history that was trumpeted forcefully by the Special Prosecutor's Office. If we refer to the official data from Public Procurement, the double standard of SPAK emerges in this story. The prosecution accused and convicted Gëlçi for favoring the company "TBS 96". But the same criminal prosecution institution has awarded a negotiated and non-competitive tender to the same company, for which it investigated the former director of RTSH.

The company "TBS 96" has been selected for the tender for the maintenance of the surveillance system in the Special Prosecutor's Office for a period of two years. This company, on its own account, secured a full 60 million new ALL from the contract. Official data reveal the payments from the State Treasury to the company "TBS 96" by the Special Prosecutor's Office during the last months. there are two payments of 7.5 million new lek for the maintenance of the surveillance system and a third payment of 2.5 million lek for the purchase of mobile phone service.

Theoretically, the case of the investigation and punishment of Thoma Gëllçi, the company that won the tender with a value of 20 million lek more than the lowest offer should have been under investigation by SPAK.

Despite this, the standard followed is double and the company in question has ironically absorbed public money from the prosecuting body itself. The entity in question was also investigated for other issues, for non-fulfillment of obligations for public tenders. In 2020, he was sued by the opposition in SPAK for a procedure classified as secret for the supply of respirators during the outbreak of the pandemic.
