SPAK closes the investigations/ Sends the former mayor of Fushë Arrëz

SPAK completes the investigations and takes the former head of the Fushë-Arrëz municipality, Fran Tuci and the administrator of the Administrative Unit Iballe Ndoc Marku, as well as the businessman Durim Margjekaj to trial.

At the end of the preliminary investigations of criminal proceedings no. 67 of 2023, the Special Prosecutor's Office against Corruption and Organized Crime submitted to the Special Court of First Instance for Corruption and Organized Crime (on 16.08.2023) the request for trial against the defendants:

1. Fran Tuci, accused of the criminal offense of "Abuse of duty", committed in cooperation, provided by article 248 and 25 of the Criminal Code;

2. Ndoc Marku, accused of the criminal offense of "Abuse of duty", carried out in cooperation, provided by article 248 and 25 of the Criminal Code;

3. Durim Margjekaj, accused of the criminal offense of "Illegal construction", provided by article 199/a pgf 4 of the Criminal Code.

From the analysis of the evidence gathered during the preliminary investigation, it turns out that it is proven that the defendants Fran Tuci and Ndoc Marku, in cooperation between them, with illegal actions and omissions which constitute regular non-fulfilment of duty, have brought as a direct consequence serious damage (estimated at ALL 234,007,500) to the property of the "forest fund" type and the corresponding terrain, registered in the cadastral office in the name of Fushë Arrëz Municipality.

While the defendant Durim Margjekaj, in the capacity of the administrator of the company "Legendari" sh.pk, with complete and direct intention, has carried out infrastructure construction works without the relevant permit, bringing serious consequences to the property of the type "forest fund" owned by the municipality. From the investigative actions, it has been proven that the former head of the Fushë Arrëz Municipality, Fran Tuci, in cooperation with the former Administrator of the Iballe Administrative Unit, citizen Ndoc Marku, with actions and omissions contrary to the law, which constitute regular non-fulfilment of duty, bringing at the same time a serious material consequence for the state, have allowed the opening of a new rural auto road segment, previously disapproved by the competent authorities.

Tuci, who was arrested on July 12, was transferred two days ago to the prison hospital because he has health problems. He was in the custody of Rec in Shkodër.

The estimates of the Territory Protection Inspectorate speak of a damage of more than 2 million euros, caused by the damage to the terrain and the deforestation of the surface from which the privately opened road has benefited.
