Judges have filed a criminal complaint regarding the non-payment of salaries of judges and prosecutors for the month of August 2026.
The report requests that the prosecution body investigate the circumstances and identify the person or persons who made, transmitted or implemented the decision that resulted in the non-payment of salaries.
Among the individuals reported is the Minister of Finance, Petrit Malaj.
The report emphasizes that the situation does not affect just one magistrate, but a significant number of judges and prosecutors throughout the country.
"Through this report, allow us to present to you the circumstances of the fact and the argumentation of your competence as well as the criminal liability of the defendants for the criminal offenses filed in the object of this report. This report is filed due to the situation created by the non-execution of the salaries of judges and prosecutors for the month of August 2026, a situation which does not affect a single magistrate, but a considerable number of judges and prosecutors in the Republic of Albania. The report is filed with the aim of the prosecution body identifying the person/persons who have taken, transmitted or implemented the concrete decision-making that has led to the non-execution of the salaries.
This report does not aim to replace administrative, judicial or institutional means for the resolution of disputes regarding the method of calculating salaries nor to exert pressure on any state institution for a certain financial result. Its purpose is only the criminal investigation of the legality of the concrete actions or omissions that have led to the non-execution of the salaries and "determination of individual responsibility according to law," the complaint states.
According to the complaint, the goal is for the prosecution to determine individual responsibility for the specific actions or inactions that led to the non-execution of salaries.
The judges also clarify that criminal reporting does not aim to replace administrative, judicial or institutional means for resolving disputes over the method of calculating salaries.
They emphasize that the initiative does not aim to exert pressure on any state institution to achieve a certain financial result, but only to verify through criminal means the legality of the actions that have led to the blocking of salaries.
