An unprecedented institutional clash between the judiciary and the executive has reached the doors of administrative justice. On September 11, 2026, the Special Court of Appeal for Corruption and Organized Crime (SCAC), represented by Deputy President Dhimitër Lara, filed an official lawsuit with the Tirana Administrative Court of First Instance against the Ministry of Finance and the Tirana Treasury Branch, with the participation of the State Attorney's Office and the High Judicial Council as third parties.

The cause of this clash was the blocking of the execution of salaries for the month of August 2026. Through the lawsuit, the Appeals Court of Appeals requests the finding of illegality and the repeal of letter no. 14110 dated September 2, 2026 of the Ministry of Finance, which suspended expenditure orders no. 190 to 196 sent to commercial banks.

The plaintiff requests the court to oblige the financial authorities to immediately execute the payrolls based on Decision No. 435 of the Supreme Court of Kosovo and Order No. 73 of the Deputy President of the Appeals Court of Kosovo, without conditioning this process on the return to the salary parameters of the month of July.

In parallel, a precautionary measure has been requested to immediately suspend the effects of the Ministry of Finance's act and unblock the Treasury system.

The legal reasoning presented in the lawsuit is based on the implementation of Decision No. 15/2026 of the Constitutional Court and the subsequent act of the Constitutional Court. These acts determined the new calculation of the reference basic salary according to Category I, Class I-2, at the rate of 222,425 lek for the salary of the position, together with an additional amount of 14,000 lek for the qualification.

According to the lawsuit, the financial control of the executive branch cannot exceed legal limits to become an administrative control or de facto suspension of acts of judicial self-government.

The lawsuit further points out that the Treasury blockade has also illegally affected judicial administration staff, against whom there is no debate or legal obstacle.

The court also argues a double-standard stance on the part of the executive body, as fiscal and social obligations have been withheld by the tax authorities according to the parameters of the new increased salary, while the execution of salaries for employees has been arbitrarily blocked.

Meanwhile, the Administrative Court today ordered that the judges of the GJKKO be paid.
