Having found disciplinary violations, the ILD demands a 40% salary reduction for
Judge Suela Dashi

The High Inspector of Justice has proposed a 40% salary reduction for one year for Judge Suela Dashi.

The disciplinary investigation found that the judge committed intentional violations in cases of unjustified absences, failure to file a request to waive the prosecution of a case, and failure to respect or incorrectly implement decisions by higher courts.

Full announcement:

The High Inspector of Justice (ILD) has launched a disciplinary investigation against magistrate SD, judge at the Court of First Instance of General Jurisdiction in Gjirokastra, following complaints filed by the deputy president of this court and two other complainants. The investigation was conducted for disciplinary violations provided for in article 102, point 1, letters “a”, “f” and point 2, letter “a” of law no. 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended.

From the totality of the facts ascertained during the disciplinary investigation, it is proven that the magistrate committed the disciplinary violations that the law provides for as:

Unjustified absence from duty for more than three working days per year;

Failure to file a request to waive the proceeding or trial of the case, when this is mandatory by law, if the magistrate is aware or should have been aware of such circumstances;

Serious or repeated failure to comply with procedural and substantive legislation or incorrect application of procedural and substantive legislation, when ascertained by a higher court.

The ILD investigative report assesses that the violations were committed intentionally, taking into account the professional experience of the magistrate. According to the report, the actions and omissions of Judge SD have violated the principles of impartiality and legality, the rights of the parties in the judicial process, as well as the prestige of the magistrate and the public's trust in the judicial system. The report also assesses that the behavior observed by the judge poses a risk of repetition of similar practices by other magistrates and creates a negative precedent for the functioning of the judicial system.

The ILD inspectors have determined that there are no objective causes or circumstances beyond the control of the magistrate that justify the violations found, while the fact that the magistrate has not previously had disciplinary measures in force and that she has cooperated during the disciplinary investigation is considered a mitigating circumstance.

The ILD has concluded that the actions and omissions of Judge SD constitute serious disciplinary violations, pursuant to Article 102, point 1, letters “a” and “f”, as well as point 2, letter “a” of Law No. 96/2016. For this reason, the ILD proposed to the High Judicial Council the imposition of the disciplinary measure “Temporary salary reduction of up to 40 percent for a period not exceeding one year” against Judge SD, provided for in Article 105, point 1, letter “c”, subsection “i”, in conjunction with Article 108, letter “b” of Law No. 96/2016 “On the Status of Judges and Prosecutors in the Republic of Albania”, as amended.
