Fiks Fare denounced on Tuesday evening the frightening negligence of the leaders and medical staff of Prison 313 in Tirana, where a detainee lost his life.

On October 28, 2023, detainee Artan Zylyftari, who was in cell number 5, on the first floor of building B of this institution, felt unwell and sought more specialized medical assistance.

The investigative show has obtained the full videos, where security camera footage has shed light on the abuse of this staff, as it is clearly seen that the nurse was "with her hands in her pockets", while the doctor was not even at work. Several other prisoners are seen in the footage, including Geri Zylyftari, the victim's brother, who is insistently seeking medical help.

"On that date, at 3:08, my brother had heart problems and fell to the ground. My brother, my cousin, and another friend were in the cell. We took my brother at 3:12 to take him out into the corridor. He walked there on his own two feet and from 3:12 to 3:30, he fell and couldn't get up. We called the employee to call the nurse and the doctor. The police called them, but the doctor didn't come near to help him, nor did the nurse," says Geri Zylyftari, in a story for Fiks Fare.

It appears that the victim was lying in the middle of the corridor, where some guards are giving him first aid. They are giving him CPR. The detainees try to help him for minutes. There is no sign of medical staff around them. "It took the nurse 15 minutes to come to that corridor. She came after so long, she didn't have anything, no medication, no equipment, no defibrillator. If she had had these things, he wouldn't have died! Because of this, he passed away," Geri continues.

Surprisingly, on that day, hour, minute and second, no doctor came to provide first aid. Only the nurse went to the detainee. "The prison also had doctors but they didn't come. The nurse only measured his pulse. His pulse had dropped and she needed a defibrillator to bring him back to life and they didn't have one. They also waited for the ambulance, it was delayed until 3:30," he adds.

The video clearly shows the negligence and incompetence of the medical staff of Detention Center 313 in such a situation. Some guards take the detainee with a blanket, to transport him to the ambulance. "They took him there with a blanket to take him to the QSUT, there was no stretcher, nothing of the kind. They knocked him down on the way. The police officers took him with a blanket. This is all absurd. Their delay and negligence took his life. There was no stretcher or anything of the kind. There was no condition, nothing of the kind," says Geri, who is also an eyewitness to what happened inside Prison 313 in Tirana.

The prosecution's file states that Artan Zylyftari died at the QSUT. "My brother died in the prison institution. They took him without a stretcher and threw him on the street. It was 3 o'clock and the doctor should have been present because something had happened in the prison institution. To my knowledge, there were doctors, but they weren't there. My brother died because of their negligence," adds Geri.

The event of October 28, 2023, remains unsolved by justice. The Tirana Prosecution Office has twice suspended the investigation into this event, despite the Court ordering an investigation into the chain of command at that time of Prison 313.

"We have reported it twice and the ICS, but the case is closed. It is closed to pass the ball to each other, to protect each other. The institution protects its own employees. Initially, the case was dismissed, we filed a complaint in court. The court ordered a reinvestigation. Again, the case was dismissed again. The prosecutor replied that the institution's employees could have been granted amnesty if they were guilty. We have seen it, no investigation has been conducted by the prosecution," says Geri, adding that the family is demanding that the case be reinvestigated and the truth revealed.

The decision to dismiss, a copy of which is available to Fiks Fare, states that the detainee Artan Zylyftari died in the emergency room of the QSUT. Citizens Geri Zylyftari, Erlind Zylyftri, Vladimir Binjaku, Lefter Hysenlika, Malik Peposhi and Sadete Kushta were questioned in their capacity as persons with knowledge of the circumstances of the investigation. Geri himself stated to Fiks that his brother died in prison and not in the hospital!

The prosecution writes in the decision that the video footage was examined, while the 24-hour activity book for the nurse in building B was also seized. Finally, it registered criminal proceedings for the criminal offense, provided for by Article 97 of the Criminal Code. This article provides that, “the failure to provide assistance, without reasonable cause by the person who by law or due to duty was obliged to provide it, when as a result serious damage to health, endangerment of life or death has been caused, constitutes a criminal offense and is punishable by a fine or imprisonment for up to two years.”

The prosecution writes that on April 24, 2024, the amnesty law entered into force, which amnestied cases in the investigation, trial and reporting phase, with sentences of up to 2 years. Finally, the prosecution writes that "it results that this law extends its effects to the criminal case in question, which was registered for a criminal offense", deciding to discontinue the investigation.

The prosecution did not deepen the investigations into the chain of command of Prison 313. What did they neglect? Who and where was the doctor? Why was the nurse late? Why were there no medications and equipment? They abused their duty, by not taking measures to prevent such situations. The investigations were also not deepened into the complaints of this detainee before the fatal event occurred. He has constantly complained about health problems, but no one took them into account!

"He has received heart therapy and they never took him for a visit. How about an EKG or an ECHO of the heart. The institution doesn't have these. It doesn't have these. If it did have these, it wouldn't have an ECHO or anything. For two or so years, they didn't have any visits," says Geri Zylyftari, as Fiks Fare asked him whether or not he had told the doctor at Prison 313 about these concerns.

"He never met the nurses or doctors. The nurse would tell him he had a cold. He would tell him he had a chest pain, he had a cold. The nurse is not a doctor, he is not a cardiologist to determine what he has, whether he has a cold or a heart attack. He has been on medication, on heart therapy. They have not given us any recommendations for specialists. He complained, measured his blood pressure because he had concerns. They would always tell him he had a cold, always the nurses," Geri concludes.

But how did the 3 members of the Zylyftari family end up behind bars?!

On January 30, 2025, Fiksi published the denunciation of Luani from the village of Orizaj in Skrapar, the father of Geri and the late Artan Zylyftari. Luani and his two sons were captured by the police during Operation "Spirit", which also included the bodyguard of the former Minister of the Interior, Saimir Tahiri.

"I was arrested as a family in 2021, along with my two sons Artan and Geri Zylyftari. We don't even know who accused us and what they arrested us for, only when they took us to prison. They left us as a structured group and there was no evidence," said Luani. He explained that the file has no evidence, but they were accused because Luani has a cousin, Ilirjan Duçollari.

In January 2025, Fiksi investigated the file of Operation "Spirit", where all episodes of drug trafficking from Albania to Italy via Divjaka beach were revealed. The leader of the group was citizen Ilirjan Duçellari, the bodyguard of former Interior Minister Saimir Tahiri, who went by several aliases: "Ilirjan Zaimi, called Kani Kafes, Daja, Sy Bardhi".

Of the entire group accused by SPAK, only ordinary people, villagers, remained in prison. Meanwhile, former police officers, former prosecutors, and accused police officials were investigated at large. This was one of the first files investigated by the Special Prosecution Office. A strong accusation of Luani was also the death of his son, in the premises of prison 313. The footage obtained by Fiks Fare documented a serious situation of negligence in the treatment of a health emergency, where a detainee lost his life after not receiving medical assistance in time.

The Tirana Prosecutor's Office has twice closed the investigation into this incident, while the family members continue to demand a reinvestigation and full verification of institutional responsibilities. This case raises strong questions about the functioning of the health service in prisons and the need for higher standards of emergency treatment, so that such cases do not repeat.
