Julian Mërtiri, the lawyer of the former Minister of the Environment, Lefter Koka, has stated that in the claim given by SPAk for the case of the Elbasan incinerator, despite the fact that it was investigated for two years, there are the same accusations of the LSI report.
Invited to the show "Zona Zona" on Top News, the lawyer stated that SPAK did not take into account the fact that the decisions were made on the basis of a decision of the Council of Ministers where the state of environmental emergency was declared. He further added that there is no evidence for all the charges against the defendants.
"We come from a report of political subjects, which was investigated for two years in a row, and the same things that are in the report were presented again. The penalties requested are based on the report and the investigation does not seem to have served to reveal the truth.
On June 1, we will prepare a defense and we hope that the court will reflect and listen to our arguments, because so far we have not been heard. Extreme measures have been given to people without being investigated, without being questioned, without giving them the right to an explanation.
These allegedly fictitious invoices were previously investigated and found to be regular. SPAK does not reflect the fact that there is a decision-making by the Council of Ministers that declared the environmental emergency in the whole of Albania. There are over 83 legal acts that have been issued in this procedure, it cannot be issued where the prosecution claims an emergency.
The prosecution has not gone deeper, it has not escalated the degree of guilt, so it gives 4 years of punishment for everyone and it seems that it has not investigated because otherwise it would give the measure of how guilty each of them is. Our defense will start on June 1, but there are 12 defendants and it will take several sessions and the court will take its own time to decide. The judgment on the merits will take some time. The charges against everyone are the same and this is unacceptable. So if you accuse a defendant of corruption, then you have to stick to that crime. Cleaning of the proceeds of crime is not proven anywhere. Where did the corruption money go? There is no evidence for this either. To prove corruption you have to prove the destination of the money, how it was received, when it was received, that there can be no corruption after 5 years after the decision was made.
Our strongest weapon is that the Prosecutor's Office has not investigated, does not prove in any case, even in any defendant, no one says that he was involved in a case of corruption. " - said Lefter Koka's lawyer, Julian Mërtiri.
