An official document from the Fier Customs Branch has revealed a serious financial scandal that raises serious questions about the way the customs administration is handling one of the largest fiscal obligations in the country.
At the center of the accusations is the Director General of Customs, Besmir Beja , who is suspected of inaction regarding the collection of over 12.3 billion lek in duties and penalties from the company Bankers Petroleum .
According to official documentation, Fier Customs has declared the company debtor for 3,095,566,890 lek in excise duty and 9,286,700,670 lek in penalties, bringing the total to the staggering figure of over 12.3 billion lek.
However, despite the procedures initiated and the existence of an execution order from the Administrative Court of Lushnja , the obligations continue to be unpaid.
"As you are aware, the Fier Customs Branch has proceeded with the materialization of the Decision on accounting for excise duties no. 98, with no. 4055/2 Prot., dated 20/10/2025, according to which the entity "BANKERS PETROLEUM ALBANIA LTD" has been declared a debtor for the excise duty, in the amount of 3,095,566,890 lek, based on article 85/2 of Law no. 61/2012 "On Excise Duties in the Republic of Albania" and has been penalized in the amount of three times the unpaid fiscal duty, in the amount of 9,286,700,670 lek, based on article 87/2 of Law no. 61/2012 "On Excise Duties in the Republic of Albania" (as amended)," the document states.
The published document states that payment notices, requests for voluntary liquidation, and forced recovery procedures have been carried out.
But absurdly, the request for execution has not been completed, as it turns out to have been sent incorrectly to the court secretariat " due to human error ."
"Furthermore, we proceeded with letter no. 4505/3 Prot., dated 22/12/2025 with the subject "Request - For the mandatory execution of Execution Order no. 488 Decision, dated 09.12.2025", addressed to the Fier Bailiff Office, but, as a result of human error by the secretariat, the letter was forwarded to the secretariat of the Administrative Court of First Instance of Lushnje and not to the Bailiff Service", the document states.
Meanwhile, instead of the state insisting on the full collection of obligations and penalties, an agreement has been signed only for the progressive repayment of the principal, while billions in penalties remain pending and without any real guarantee of collection.
The document creates the appearance of a paralyzed administration, where files are scattered around offices, procedures are delayed, and execution orders are " lost " along the way, while the state budget loses billions of lek.
"The Fier Customs Branch, following the handling of voluminous written correspondence, meetings held in the premises of the General Directorate of Customs, as well as following our letter with the subject "For further proceedings", has been awaiting the handling of the problematics on the handling by the superior body for the implementation of Article 106 of Law No. 61/2012 "On Excise in the Republic of Albania" (as amended). In conclusion, taking into account the above, as well as the fact that the act-agreement for the progressive collection of the principal has currently been concluded, while the penalty remains uncovered, we request your express guidance regarding the continuation or not of the procedures for the mandatory execution of the Execution Order No. 488 Decision, dated 09.12.2025 at the competent enforcement service. This request is submitted in the conditions where the statute of limitations for the fine are limited and any further delay may "harm the fiscal interests of the customs administration," the request states.
The questions that require answers are straightforward:
Why has the execution of this colossal debt not been completed? Who is preventing the execution of the company?
And why is the customs administration failing to protect the public interest in the face of such a large obligation?
It now remains in the hands of SPAK to verify whether we are dealing with administrative incompetence or a well-organized scheme to delay and avoid collecting the billions owed to the Albanian state./ Timoni
