Declaration of the National Association of Judges of the Republic of Albania :

The National Association of Judges of the Republic of Albania strongly condemns the violent acts that occurred during the recent protests, which have violated the security and integrity of the justice institutions. The attacks on the buildings of the Supreme Court and the Court of Appeal of General Jurisdiction, including arson in the premises of the Supreme Court and damage to court files, constitute unacceptable acts in a democratic society. These actions not only endanger the lives and safety of judges, judicial officers and administrative personnel, but directly violate the normal functioning of justice. Any obstacle to the activity of the courts translates into concrete consequences for citizens, whose access to justice is delayed or made more difficult. The constitutional freedom of expression and assembly is a fundamental value of democracy, but its exercise cannot serve as a justification for violence against institutions and the violation of the security of people who exercise their duties in them. Violation of the courts weakens the protection of constitutional freedoms and rights.

Equally alarming is the concern about the lack of appropriate preventive and protective measures by the State Police structures, which have the legal responsibility for guaranteeing public order and security. The protection of judicial institutions cannot be treated as a secondary task, much less remain dependent on unforeseen developments during public gatherings. The security of courts and of persons exercising functions in them requires special attention, planning and effective response from the responsible authorities. Justice is a goal of the State, as much as of the individual. Particularly worrying is the exposure to acts of violence of institutions that provide justice services, while their protection is a necessary condition for the functioning of the rule of law. Guaranteeing the security of these institutions is not a matter of institutional privileges, but a state obligation towards citizens and the public interest.

In this tense climate, the Association considers equally problematic the inappropriate language used publicly by the Prime Minister towards judges who have reviewed or are reviewing the prosecution's requests for the imposition of security measures against protesters. Criticism of judicial decision-making is legitimate, but it cannot be transformed into a personal attack, delegitimization of judges or public pressure on the exercise of their function. Such statements, especially when coming from the head of the executive branch, risk creating the perception of interference in independent judicial decision-making. They negatively affect public trust in judicial decisions. The responsibility of the head of the executive branch is to guarantee respect for constitutional freedoms and public security, not to prejudge the decisions of the courts or to publicly determine which security measures should be imposed. The legality and proportionality of these measures are assessed only by the courts, on the basis of the law, evidence and concrete circumstances of each case.

The Association calls on all state institutions and factors with political and public responsibility to show restraint, responsibility and respect for the independence of the judiciary. Tense situations in the public sphere require constructive stances and institutional actions with vision and statesmanship that strengthen the security, legality and trust of citizens, not rhetoric that divides or clashes fictitiously and uselessly between powers. The Association demands the immediate adoption of effective measures for the security of the courts and their personnel, as well as the prohibition of any form of pressure on judges due to the exercise of their duties, above all as an obligation to serve citizens. At the same time, it expresses full support for judges who fulfill their function with independence, impartiality and integrity. Without safe and independent courts, there can be no tangible justice for citizens nor a state of law.
