Scenarios: What happens to the elections in Tirana if the Constitutional Court
Erion Veliaj

Will there be elections in the Tirana municipality or not? The future of the capital's governance is in the hands of the Constitutional Court, whether it will decide to have the mayor lead from prison, or allow a race between Ogerta Manastirliu, Florian Binaj and Arlind Qori.

After the end of the 7-hour public hearing where Erion Veliaj faced the government and the presidency in front of judges regarding his dismissal from office as mayor, the Constitutional Court must announce the reasoned decision within 30 days according to the law.

Meanwhile, Top Channel learns that due to the interest of the issue, communication on the decision-making on the fate of the Municipality of Tirana is expected to be made at the beginning of the week.

Veliaj asked the Constitutional Court to annul the president's decree to hold elections on November 9 in Tirana and not to recognize the dismissal decision, while the elections were previously suspended.

The question is how will the judges decide next? The Constitutional Court's decision-making has three options on the table: either to dismiss Erion Veliaj, or to accept his request in full or the option of accepting it partially. In Top Channel's analysis of the fate of the Tirana municipality, the third option is rejected as long as Veliaj's two requests are linked to each other.

If the dismissed mayor's claim is fully accepted, Veliaj will be reinstated, albeit in handcuffs, and the elections will be annulled. And if the judges decide by majority vote or unanimously to reject Erion Veliaj's request, by-elections will be held in Tirana.

But certainly not on November 9, as President Bajram Begaj decreed. His lawyer stated during the session that the presidency's authority to set a new election date has been exhausted. Therefore, the Constitutional Court must decide in their judgment also on the time when the vote will be held in the capital.

"In case you reject the request, you must take measures so that the elections in Tirana can be held after the entry into force of your decision, as the electoral code sets a deadline of 30 days minimum up to 45 days to set the new election date," said Ilir Rusmailit.

If we calculate the deadlines in case it is decided to hold elections in Tirana, then the earliest possible period is December, but if we go to the maximum of the legal deadline, the furthest date is expected to be January 14. Although we still need a little patience to know if the early elections in Tirana will take place./TCH
