The Constitutional Court has not accepted the request of the Democratic Party to consider the decision of the Assembly not to establish the Investigative Commission for strategic investments as unconstitutional.
The request did not pass at all in the plenary session and was dropped in the meeting of judges in the preliminary session and the reason was the number of members of the deputies. According to the Constitution, the request should have been sent by the same people who had signed for the establishment of the Investigative Commission (that is, 35 deputies) and not 28.
The Constitutional Court in its decision highlights the fact that we are dealing with a request for conflict of powers with the argument that it does not meet the formal criteria, since there were fewer deputies' signatures than 1/4 of the Assembly, as required by the Constitution for the establishment of an Investigative Commission.
The decision was taken by majority vote, while the members of the Constitutional Court, Sonila Bejtja and Marsida Xhaferllari, voted against and gave a minority opinion. According to them, the request met the conditions for the start of the constitutional trial and should be considered in the plenary session.
We remind you that in the plenary session of last June 23, the Assembly rejected with 74 votes the request of the democrats for the establishment of the investigative committee of the Assembly to verify the implementation of the law "On strategic investments in the Republic of Albania".
