Ilir Beqaj open letter to Xhafaj, Gog and Manja: GJKKO is violating my rights

Former Minister Ilir Beqaj has reacted regarding the criminal process against him at the Special Court against Corruption and Organized Crime (SCOC).

In an official letter addressed to the chairman of the Laws Committee, Fatmir Xhafaj, the chairman of the Security Committee, Ulsi Manja, and the Minister of Justice, Toni Gogu, Beqaj argues that a provision of the Criminal Procedure Code is being implemented in a way that, according to him, violates the constitutional division of roles between the prosecution and the court.

According to him, this is Article 332/d, point 3, which gives the judge of the preliminary hearing the right to request the correction or clarification of the accusation from the prosecutor.

Beqaj claims that in this specific case, this provision led to the change of the charge from "abuse of office" to "theft by abuse of office", not as a result of the prosecutors' persuasion, but due to the court's "suggestion".

He points out that the prosecutors themselves have stated that the initial accusation was correct, but have accepted the change to avoid a procedural deadlock. According to Beqaj, this situation creates a dangerous precedent, where the accusation does not originate from the prosecution, but is influenced by the court.

In the letter, the former minister argues that the change in the charges was not communicated to him in a regular manner and by formal act by the prosecution, as required by law and the standards of the European Convention on Human Rights, violating his right to defense.
