Following SPAK's request for authorization from the Albanian Parliament to lift Belinda Balluku's immunity, several steps are being followed based on the procedure provided for in the Regulation, which applies even when the MP is a member of the government.
The request is submitted to the Speaker of the Assembly, in this case, Niko Peleshi.
The latter immediately forwarded it to the Council on Rules of Procedure, Immunity and Mandates, informing the deputy, minister and number two in the government, Belinda Balluku.
Meanwhile, the Mandates Council will meet on Friday to review the request of the Special Prosecution Office to lift the immunity of Deputy Prime Minister Belinda Balluku.
Once officially notified, Balluku has the right to provide explanations, be represented by a lawyer, and fully exercise his right to defense.
The Council reviews the request and within 2 weeks drafts a report, recommending its approval or rejection.
The report is distributed to the deputies.
The request is then included as the first item on the agenda in the plenary session.
According to the Rules of Procedure of the Assembly, the MP for whom the request was made takes the floor, without opening a discussion on the report.
The decision is made by open vote.
If the Assembly does not express its opinion within 3 months, the request of the Special Anti-Corruption Prosecutor's Office is considered rejected.
