Objects confiscated for violation of building permits will be able to be completed by the state and then handed over to citizens who have entered into purchase, enterprise or promise-sale contracts with builders and developers. This is one of the main changes envisaged by the draft law on the administration of confiscated buildings, which also aims to resolve the situation of buyers who have paid for properties in unfinished buildings.

The Chief Administrator of the Agency for the Administration of Sequestered and Confiscated Assets (AAPSK), Risena Xhaja, during discussions in the Parliamentary Committee on Health and Social Welfare, explained that the amendments to Law No. 66/2023 aim not only to confiscate buildings built in violation of the permit, but also to complete them and hand them over to persons who have contractual rights over these assets.

According to her, the current legislation provides for the confiscation of the object, but does not establish the obligation to complete the works. It is precisely this deficiency that the proposed amendments aim to correct.

"What the draft law we propose undertakes is to complete all the buildings that were left unfinished by the builders and to give the completed assets to the entities that had entrepreneurship and promise-sale contracts," stated Xhaja.

She emphasized that this is one of the essential changes in relation to the existing legal framework.

"The current Law 66 does not provide for this norm, therefore it does not provide for the object to be completed, but simply provides for its confiscation, while with the legal amendments we have also provided for the completion of the entire object and its delivery to the persons who purchased it", explained the chief administrator of AAPSK.

In this way, the state aims to take over the completion of confiscated constructions, creating the opportunity for citizens who have invested their savings in purchasing apartments to receive the properties for which they have signed contracts.

However, the implementation of this scheme will depend on the verification of contracts, the physical condition of the facilities, and the procedures provided for in the law.

How will buyers be verified and how will construction be completed?

Another important element of the draft law relates to the identification of persons who have rights over apartments or other units in confiscated buildings.

According to Xhaja, the draft law foresees the establishment of a working group that will review contracts signed before a notary, with the aim of identifying the legitimate beneficiaries.

The envisaged mechanism will function based on the requests that the Ministry of Economy will submit for social housing needs.

AAPSK will identify available and suitable assets, while their transfer to the Ministry of Economy will be made through decisions of the Council of Ministers.

The uncle emphasized that the properties that will be used for social housing must be completed and meet the necessary standards for family housing.

Investors are excluded from the benefit of assets

Another important change relates to the exclusion of investors from benefiting from confiscated assets.

According to Xhaja, this definition aims to avoid the possibility that entities involved in construction development benefit from assets subject to confiscation.

The Chief Administrator of the AAPSK also clarified that legalization procedures are not part of the draft law under discussion.

She explained that subjects will have to self-declare their situation in relation to the legalization process, while cases that are not included in the conditions and deadlines set by the relevant legislation will be treated according to confiscation procedures.

A new mechanism for citizens who have paid for apartments

The proposed amendments to Law No. 66/2023 aim to address an important problem in the real estate market: the situation of citizens who have entered into contracts for the purchase of apartments, but the buildings where these properties are located are left unfinished and are subsequently subject to confiscation for violations of building permits.

The main innovation is that confiscation will not remain just a measure for taking property from the state, but will also be accompanied by a mechanism for completing the facility and handing over the units to buyers who prove their contractual rights.
