The Constitutional Court has rejected the request of the Democratic Party deputies, who opposed the election of the People's Advocate.
Today's decision of the Constitutional Court states that some of the claims raised by the 44 Democratic MPs, including the issue of the signatures of 28 MPs, the rule "one MP supports only one candidate", the interpretation of Article 72 of the Rules of Procedure of the Assembly and the claim of a political agreement between the majority and the minority, do not raise constitutional issues.
The deputies demanded the verification of the eligibility and incompatibility of the Ombudsman with the function, as well as the verification of the procedure for his election and the repeal of the Assembly's decision of December 11, 2025.
Regarding the selection criteria, the Court considered that the Assembly has discretion in the professional assessment of candidates for constitutional offices, as long as the basic procedural guarantees are respected and there is no arbitrariness. In the present case, it found no violation of these guarantees.
The court also dismissed the claim of incompatibility due to the candidate's political activity, deeming this claim unfounded.
The claim that the election was invalid due to the lack of support from MPs at the time of the vote was also rejected. According to the Court, the condition of support from 28 MPs was met at the stage of verification of the candidacies by the Laws Committee and the withdrawal of support after passing this stage no longer produced consequences in the parliamentary procedure.
Thus, the Constitutional Court unanimously decided to reject the request, while the reasoned decision will be published within the legal deadlines.
