The Chairman of the Democratic Party of Kosovo, Bedri Hamza, announced that the PDK Parliamentary Group has submitted to the Assembly the request to amend the Law on the Kosovo Specialized Chambers.

Hamza said that Kosovo is going through difficult days and that citizens' protests against the decisions of the Special Court cannot be ignored. According to him, even the Kosovo Assembly cannot act as if this issue has no impact on the country.

"This court was not imposed by a United Nations Security Council resolution, but was created by the Constitution and laws approved by the Kosovo Assembly," Hamza declared.

He stated that the process that led to the creation of the Specialist Chambers began with the Dick Marty report and the Council of Europe resolution, where, according to him, the focus of attention was on serious allegations against the Kosovo Liberation Army and its war.

"Kosovo made a difficult decision and acted with the conviction that it had nothing to hide. Today, after more than a decade, there is a fact that demands answers. A case has not been filed in the Specialist Chambers regarding Marty's allegations," said Hamza.

According to him, the draft law proposed by the PDK does not aim to close the Specialized Chambers nor to hinder investigations or processes related to their mandate.

"If Kosovo created this Court with a special mission, should this mission have a limit? The draft law gives a clear answer. It does not require the closure of the Specialist Chambers. It does not require that the charges related to the allegations for which the Specialist Chambers were created not be investigated. Those cases will continue to be part of their mandate. This is not an initiative for impunity. It is an initiative to predetermine who has the right to judge what," he said.

Hamza said that the draft law also addresses the issue of cases currently in judicial process in The Hague. According to him, the existing procedures would continue until the end of the Appeal phase.

"According to the proposed solution, the current proceedings continue until the end of the Appeals phase, but if a case is returned for retrial, it will not start all over again in The Hague. At that point, the new jurisdiction applies and, when the conditions are met, the case will be transferred for proceedings in Kosovo," stated the PDK leader.
