The order issued by the Minister of Finance, Anila Denaj for the suspension of the fine against Bankers

In July 2019, when the customs administration had activated bailiffs to collect the 80 million euro fine imposed on Bankers Petroleum, an 'order from above' suspended the proceedings.

The order issued by the office of Anila Denajt, at that time the Minister of Finance and Economy, which reports to the Directorate of Customs and Taxes, was justified by the alleged "complexity of the case, both in terms of the volume of the file and the amount needed collected'.

"From the examination of the materials...it turns out that we are dealing with a very important and complicated problem, either from the figure ascertained, or from the time span...For the above, the customs authority should proceed with the suspension of the procedure" , it is stated in the decision of Minister Denaj.

Simply put, the Minister ordered customs to stop the execution of the 80 million euro fine against Bankers Petroleum on the grounds that the fine was too large and that the problem was too complex.

From the correspondence between Bankers and Customs, the problem was not as complex as the minister says. Bankers has been caught breaking the law by avoiding excise duty on fuel thinners. The value of the evaded tax was around 25 million euros and according to the law, Bankers was fined three times the amount, totaling around 80 million euros.

In April of this year, the Supreme Court overturned the decisions of the two lower courts and upheld the fine, which, together with interest and other penalties added to it, amounted to almost 100 million euros. The decision of the Supreme Court is the removal of any barrier that the institutions had for the execution of the fine and the collection of a sum of money, so necessary for the government in this period of price crisis.

Although it has had the decision of the Supreme Court in its drawer since at least June, the Customs Directorate has not taken any action to collect the fine. Reasons for the non-reaction are not given, but in the corridors of this institution there is talk of a major affair, where 'orders' are given orally from above.

How high the obstacle goes in the execution of the fine, perhaps an investigation by the justice bodies can reveal it. What is known at the moment is that Albanians are being asked to make sacrifices, as the government forgives lawbreakers taxes and fines of millions of euros.
