Two laws operating in the field of energy are not fully harmonized with each other.
The articles of the law on the electricity sector of 2015 do not match the articles of the law on the promotion of the use of energy from renewable sources, of the year 2017.
The discrepancies stem from an Investment Council analysis. The council says that point 6 B of article 37 of the 2015 law determines that producers and self-producers do not need a license if the installed capacity is up to one megawatt.
However, Article 15 of the 2017 law on encouraging the use of renewable energy sources, determines that small companies or self-producing households cannot install panels with a capacity of more than 0.5 megawatts.
For this reason, the Committee advises to unify the installed power of self-producers, going to the maximum capacity of 1 megawatt, which according to the analysis would cover the domestic electricity needs for all self-producers of this category.
Officially, the Ministry of Infrastructure says that the reason that this limit is not increased is related to the forwarding capacities of the OSHEE network, which requires investment. But, unofficially, Vox News learns that the real reason is cash flow.
Increasing the limit would consequently increase the number of self-producing businesses that would meet their energy needs and the excess, as the law provides, should be bought by OSHEE.
This means less receipts and more payments towards renewable energy.
