Arben Ahmetaj was not only involved in the concession of the Elbasan incinerator, but also had an essential role in determining the form of the procedure followed.

Etleva Kondi, the representative of the Ministry of Infrastructure and Energy in this concession says before SPAK:

“Me propozim edhe të juristit të Komisionit, i cili ishte në detyrën e drejtorit juridik dhe legjislacionit në Ministrinë e Zhvillimit, Ekonomisë, Tregtisë dhe Sipërmarrjes (fushë e veprimtarisë së të cilës ishin edhe vetë koncesionet), propozoi dhe argumentoi si ligjore dhe në përputhje me ligji me ligjin idenë e referimit të zhvillimit të procedurës në kushte emergjente, duke iu referuar ligjit për prokurimin publik, negociim pa shpallje, i cili na argumentoi se ligji për koncesionet nuk parashikon situata emergjente dhe konkretisht, dispozitat e këtij ligji shpreheshin se përveçse kur rregulloheshin ndryshe nga ky ligj, kuptimi i termave të përcaktuar në ligjin e prokurimit publik zbatohet për këtë ligj në përputhje me rrethanat.
