The government blindly proposed the establishment of the food price control board, without having a proper study of the market and the impact that the start of the war in Ukraine had on prices.

This is the main argument by which the Constitutional Court overturned the normative act approved a year ago for the control of the price of food in the markets.

Normative acts issued by the Government take the force of law immediately. But, unlike laws, they avoid public consultation and pass through an accelerated procedure in the Assembly after being discussed in the relevant parliamentary committees.

In the case of the food board, the Constitutionalist says that the discussions in the Assembly were formal and not based on market research.

"The court notes that the accompanying relations of the contested normative acts do not contain an assessment of the concrete impact on the national market and the Albanian consumer from the situation created in the international market and of the effects of the Russia-Ukraine war in this situation, even in the relation of the normative act the war in Ukraine it is not even mentioned as a cause of emergency", says the decision of the Constitutional Court.

On February 22, the court overthrew the food board, while the fuel transparency board is still under review, accused of setting fictitious prices that do not reflect their fluctuations in international markets and that it is under the control of oligarchs.

The same procedure as the food board has been followed for the fuel board, where during the review of the normative act in the Assembly there is no accompanying study in relation to clarifying the effects of the war in Ukraine.
