Fines for environmental pollution are increased, administrative measures are 30

Two of the four laws, which provide for a 30% increase in environmental fines, have been submitted to the Assembly for discussion, being one step away from approval. According to the relations that accompany the draft laws "On the protection of the environment" and "On the protection of air quality in the environment" it is intended that through heavier penalties there will be an improvement in terms of the quality of the environment.

Meanwhile, the penalties affect the entities that are equipped with environmental permits and that have a series of obligations in terms of environmental protection, due to the activity they exercise.

According to the new proposals in the law on air quality, operators who have a type A environmental permit, where those activities that cause the highest pollution in the environment are introduced, the amount of fines in case of non-compliance with the conditions will vary from 1.3 - 2.6 million lek. For type B environmental permits, the fines will range from 390 - 650 thousand ALL.

Also, it is foreseen that the fines will be toughened in the event that the entities do not report on the discharge and transfer of pollutants or on many other offenses provided for by the law "On environmental protection".

Meanwhile, the government expects a 40% reduction in the level of pollution in urban areas by 2024 by applying higher fines to offenders.

At the same time, the legal changes provide for the return of administrative offenses to executive title, with the aim of collecting them from enforcement offices. This measure aims to bypass court appeal procedures, increasing their collection.
