Contrary to what was expected, the changes made to the property law did not speed up the compensation process. Referring to the ATP report, during the past year, only 9 families were compensated, while the number of applications made by citizens was also low. Thus, in the span of 12 months, only 329 requests were filed, of which 319 were for Physical Financial Compensation and 10 for Compensation with a Special Request.

Meanwhile, official data show that from the entry into force of the reformed law in 2015 and until 2023, 812 families have been compensated with a fund of about 7.9 billion ALL or about 79 million dollars. Also, 717 hectares of land were distributed from the physical fund.

The progress of the process has also been conditioned by successive legal battles, through which the property law has had to go. After the lawsuit filed by the Muslim Community of Albania, since November the process has been suspended again pending the next decision by the Constitutional Court.

With the changes made in 2022, the compensation scheme was revised for those families who are affected by the change in the cadastral item, i.e., who had a land, which currently has the status of land but at the time of confiscation it is outside the yellow line. In these cases, the law stipulates that the owners benefit from 10 percent of the compensation value. The changes also affect those families who previously benefited from part of the property, so it was returned to them.

If under the previous law these families were considered compensated, with the new scheme they will receive 10 percent of the difference between the remaining property and the one returned. Regarding the method of compensation, in addition to traditional schemes such as physical and financial compensation, a new form of compensation for about 25 thousand owners who have been on the list for almost 3 decades, will also be compensation with shares.

Owners will be offered the opportunity to benefit from shares in companies with state capital or in commercial companies where the state owns shares that have the same value as the real estate.
