Online betting, no more than 10/ From selection to media advertising, how it

The Council of Ministers has approved a day before "Some additions and changes to the law no. 155/2015, "for games of chance in the Republic of Albania", where they are clearly defined from the granting of licenses, the operation of online bets, to their advertising in the media.

The granting of the license at the national level will be limited, no more than ten. The selection of the entity that will carry out the activity will be carried out by the Licensing Commission, in accordance with the evaluation criteria.

"1. The AMLF publishes on its official website, in 2 international newspapers as well as in the Bulletin of Public Notices, the notice of competition for the granting of the license for the provision of on-line bets which are limited in number at the national level to no more than 10 (ten).

The selection of the subject is carried out by the Licensing Commission, in accordance with the evaluation criteria, deadlines, competition procedure and scoring, determined by the instruction of the minister responsible for finance".

Who can get a license and the criteria they must meet

Article 22 clearly defines who can apply for a license in the "Online sports betting" category. The amount of capital must be no less than 40 million ALL, while the entity must also declare the source of income that will be invested for the exercise of the activity.

"1. Any legal person or association of legal persons, local or foreign, that wants to be provided with a license in the "Online sports betting" category, must meet the minimum criteria, as follows:

a) To be a joint-stock company, with headquarters in the territory of the Republic of Albania, registered with the National Business Center, in the object of whose activity is reflected the gambling activity in the category "Online sports betting".

b) The amount of capital must not be less than 40,000,000 (forty million) ALL, which value cannot be lower for the entire period of validity of the license.

c) To declare the source of the capital that will be invested for the exercise of the activity for the "Online sports betting" category.

ç) The applicant entity or, at least, one of its shareholders has experience in the field of gambling in no less than 3 EU/OECD countries and for no less than 3 years.

d) The applicant entity or at least one of the shareholders must have generated in the last financial year at least 2,000,000,000 (two billion) ALL in turnover from activity in the field of gambling, as well as have the appropriate administrative and organizational capacities and the appropriate reliability to successfully engage in such activities.

dh) To present the restrictions on changes of ownership of shares for licensees, in accordance with the provisions of this law.

e) To have the agreement with the authorized entity for the use of programs/systems/Websites/applications necessary to carry out online sports betting activity. If the subject uses the system/application owned by him, he must be authorized for this function as well".

The applying entity pays a license application fee in the amount of 500,000 (five hundred thousand) ALL which goes in favor of the AMLF and is non-refundable regardless of whether the entity's application is successful or not."

A solidified fund in favor of the Ministry of Finance

In article 47, some changes are made that provide for the freezing of funds in favor of the Ministry of Finance and the AMLF.

" For the creation of guarantees for the winners of the games of chance, the organizer of the category "Online Sports Betting" is obliged to solidify a fund of 120,000,000 (one hundred and twenty million) ALL, but not less than 5% of the sums made available to the game by the players within a previous financial year, in a special bank account, in favor of the Ministry of Finance, which is unlocked only by order of the minister responsible for finance t".

“Për krijimin e garancive për shlyerjen e detyrimeve periodike karshi AMLF-së, organit tatimor etj, organizatori i kategorisë “Baste sportive on-line” është i detyruar të ngurtësojë një fond prej 50 000 000 (pesëdhjetë milionë) lekësh, në një llogari të veçantë bankare, në favor të AMLF-së, i cili zhbllokohet vetëm me urdhër të ministrit përgjegjës për financat.”, thuhet në projektligj.

Detyrimet tatimore dhe pagesat e tjera

Ku do të ofrohen bastet online?

Sipas nenit 20 të projektligjit bastet sportive on-line do të luhen nëpërmjet pajisjeve elektronike apo kompjuterike si smartphone, tabletëve, Ipad-ëve, laptop-ëve, por pa u kufizuar vetëm në to, në faqet zyrtare të internetit, aplikacionet e subjekteve të licencuara për ushtrimin e aktivitetit “baste sportive on-line”, dhe vetëm nëpërmjet programeve apo platformave të autorizuara nga Komisioni i Licencave, sipas parashikimeve të këtij ligji dhe akteve nënligjore.”.

Programet/sistemi/website-t/aplikacionet ku do të luhen bastet sportive on-line duhet të plotësojnë kushtet dhe standardet minimale të përcaktuara me udhëzim të ministrit përgjegjës për financat, me propozim të Komisionit të Licencave.

2/1. Publiciteti lejohet të kryhet nga organizatorët e lojërave të fatit të licencuara në përputhje me rregullat e përcaktuara në këtë ligj:

b) në faqet on-line të autorizuara të këtyre subjekteve;

c)nëpërmjet vendosjes së materialeve vizuale në vende publike shprehimisht të përcaktuara në këtë ligj.

2/2. Publiciteti lejohet të kryhet edhe në median audiovizive nga organizatorët e lojërave të fatit “baste sportive on-line”, “bingo televizive” dhe “lotari kombëtare” në kushtet, si më poshtë vijon:

a) Nga organizatorët e lojërave të fatit “baste sportive on-line”, gjatë kohës së transmetimit të eventeve sportive si dhe gjatë kohës së transmetimit të programeve sportive të lidhura me këto evente sportive që transmetohen në intervalin kohor 22:00 – 08:00, si dhe vetëm në kushtet e parashikuara në këtë ligj dhe në rregulloren e miratuar nga Komisioni i Licencave;

b) Nga organizatorët e lojërave të fatit “Lotari Kombëtare” dhe “Bingo televizive” për transmetimet në intervalin kohor ditor 20:00 – 08:00.

2/3. Publiciteti lejohet të kryhet nga organizatorët e lojërave të fatit të kategorisë “kazino”, “kazino të vendosura në hotele me pesë yje” dhe “resort kazino” edhe në ambientet e porteve dhe aeroporteve, sipas kushteve të parashikuara në rregulloren përkatëse, të miratuar nga Komisioni i Licencave.

Subjektet e licencuara për lojëra fati lejohen të sponsorizojnë skuadra sportive si dhe të bëjnë publicitet të aktiviteteve të tyre në vendet ku zhvillohen veprimtari sportive, me përjashtim të eventeve sportive të të gjitha disiplinave për kategoritë nën 21 vjeç.

It is allowed to place visual materials, signs or orientation boards by the organizer of gambling games of the category "casino", "casinos located in five-star hotels" and "casino resort", only at the central entrance to the casino. In any case, the sign may contain only the name or brand of the casino and the direction arrow pointing towards the entrance of the casino.

The format and rules for the broadcast of permitted gambling publicity is approved by the License Commission, after receiving the opinion from the AMA./ Monitor
