The government gives the green light to the return of online sports betting. On July 19, the Council of Ministers approved the amendments to the law on gambling, according to which it is foreseen that the activity of sports lotteries will no longer be at physical lotto points, but only online.

Online betting on smartphones, tablets and applications
Online betting will be played via smartphones, tablets, Ipads, laptops, but not limited to them. Also, try to play on the official websites, the applications of the entities licensed for the exercise of the "online sports betting" activity. These platforms will be authorized by the Licensing Commission, which will be established in the Gambling Supervisory Authority, (AMFL)

10 licenses at the national level
Under the new law, the license to offer online betting will be limited. No more than 10 licenses will be issued throughout the country.
The applicant entity or, at least, one of its shareholders has experience in the field of gambling in no less than 3 EU/OECD countries and for no less than 3 years. It must also have generated in the last financial year at least 2,000,000,000 (two billion) ALL of turnover from activity in the field of gambling.

It must also be a joint-stock company with headquarters in the territory of Albania and be registered with the CKB, in the activity facility for games of chance in the "Online sports betting" category. The system where the online sports betting games will take place must operate on a server that can be monitored online by the AMLF.

Capital not less than 40 million ALL, declare the source.
According to the new law, the capital that the subject must have to obtain the license has been doubled. The entity must have a capital not less than 40,000,000 (forty million) ALL, which value cannot be lower for the entire period of validity of the license.

 It must also declare the source of the capital that will be invested for the exercise of the activity for the "Online sports betting" category. If the shareholders of the applicant entity are individuals, they must not be convicted by a final decision and must not be under criminal prosecution for fiscal and/or customs evasion, abuse of office, bribery or bribery, theft, trafficking in narcotics or weapons, money laundering and financing of terrorism, explosives, non-payment of fines or other criminal offenses that compromise the person's honor and personality. He must not be a debtor either. to state institutions.

The license application costs 500,000 (five hundred thousand) ALL which goes in favor of the AMLF and is non-refundable regardless of whether the subject's application is successful or not."

The licensing fee is doubled for online betting.
Changes are also foreseen in the licensing fee. Online sports betting and track racing betting, for the entire licensing period, is 400,000,000 (four hundred million) lek, compared to 200,000,000 (two hundred million) lek that was provided for in the previous law for sports betting and track racing betting.

Competition for obtaining the license
The granting of the license for the provision of online betting will be done through a competition that will be opened by the AMLF. The Licensing Commission within 10 days from the end of the selection process approves the list of participants in the competition, ranking them according to the points received. The candidate, who received the highest number of points, is declared the winner. Meanwhile, the Minister of Finance approves the granting of the license, after the applicant declared the winner has submitted, within 30 days, the fulfillment of the criteria related to the guarantee fund.

120 million solidified, guarantee for the winner of the games of chance
To create guarantees for the winners of the games of chance, the organizer of "Sports betting on-line" is obliged to solidify a fund of 120 000 000 (one hundred and twenty million) lek, in a special bank account, in favor of the Ministry of Finance, which is unlocked only by order of the minister.

50 million guarantees for the state
In addition to the guarantees for the repayment of periodic obligations towards taxes and the AMLF, the organizer of the category "On-line sports betting" is obliged to solidify a fund of 50,000,000 (fifty million) lek, in a special bank account, in favor of the AMLF. This too is unlocked only by order of the minister responsible for finance.

Publicity returns to electronic media and sports shows on TV after 22:00
Unlike the previous law, with the new changes, publicity will be allowed in electronic media and authorized online pages of these subjects.
Publicity will also be allowed to be carried out in the audiovisual media by the organizers of "online sports betting", during the time of broadcasting of sports events as well as during the time of broadcasting of sports programs related to these sports events that are broadcast in the time interval 22:00 - 08:00, as well as only under the conditions provided for in this law and in the regulation approved by the Licensing Commission.

But the publicity of the gambling activity during the edition of news and informative programs related to politics is prohibited. Also, the publicity must not be addressed to minors and must clearly contain the phrase "Gambling is addictive. Caution in their excessive exercise". The Commission of Licenses approves the regulation of the game of chance "online sports betting" proposed by the organizer and the format and rules of transmission of the permitted publicity of the games of chance, after receiving the opinion of the AMA.".

It will be allowed to sponsor sports teams, publicity in stadiums
Entities licensed for gambling are allowed to sponsor sports teams as well as to advertise their activities in places where sports activities take place, with the exception of sports events of all disciplines for categories under 21 years of age.

Sports and culture projects will be supported.
AMLF will also create a special fund for the revenues obtained from online sports bets which will go to support projects in the field of sports, culture, innovation and innovation technology, based on the request for financing projects submitted by state institutions.

Advertisements of casinos of 5-star hotels and in ports and airports
Likewise, publicity is allowed to be carried out by the organizers of games of chance of the category "casinos", "casinos located in five-star hotels" and "casino resorts" also in the premises of ports and airports, according to the conditions provided in the relevant regulation, approved by the Licensing Commission.

Directional signs to casinos in 5-star hotels or casino report are allowed.
Similarly, it is allowed to place visual materials, signs or directional signs by the gambling organizer of the category "casino", "casinos located in five-star hotels" and "casino resort", only at the central entrance to the casino. In any case, the sign may contain only the name or brand of the casino and the direction arrow pointing towards the entrance of the casino.

Who holds the online sports betting licences?
The Licenses Commission will be set up under the Gambling Supervision Authority, for the review and assessment of applications submitted in connection with the gambling activity. The organization of the commission's work and activity is done by order of the minister responsible for finance.
They will be part of this commission

The chairman is one of the 2 representatives of the Ministry of Finance.
Two representatives from the Ministry responsible for Finance;
A representative from the ministry responsible for the Economy;
A representative from the ministry responsible for Social Affairs;
A representative from the National Information Society Agency.
The members of the Commission are appointed once every four years. and the Ministers can also appoint as members persons who do not exercise public functions and who have no less than 5 years of work experience. The members of the commission are obliged to sign the declaration of confidentiality and the declaration of absence of conflict of interest, case by case.

 We remind you that sports lotteries in our country were closed on January 1, 2019, but those online illegally have continued despite frequent police actions to track and stop them. The head of the Olympic Committee, Fidel Ylli, has been one of the people who has insisted a lot on the return of online betting but to have strict control.
