The lightning response that Arben Kraja returned to Edi Rama, after the request of the latter to investigate Sali Berisha and Ilir Meta to create the idea that the head of the Special Prosecution is completely sure of what he says.

"I have no comment, because we work with reports and not with political statements," said the head of the Special Prosecution, Arben Kraja. But, more than true, this is the alibi raised by him to oppose Rama's criticism of why Berisha and Meta are not being investigated.

Alibia is weak and that the SPAK itself, which Arben Kraja has run for almost three years, has overthrown in at least 3 cases. According to this statement, SPAK can investigate only with the reports that reach the door and can not investigate on its own initiative.

The first case that overthrows the alibi of Arben Kraja arrives since January 2020, when he had not yet completed the month that he was put into operation. Following the publication of a video in which it was alleged that the former mayor of Bulqiza, Lefter Alla, was consuming drugs, the Special Prosecution announced the beginning of the investigation, mainly on the accusations of possession of narcotics.

One month later, in February 2020, SPAK launched an investigation without the need for a report from anyone for a tender worth 15 million euros for Porto Romano. 

In February 2021 is the next case when SPAK started investigations without the need for a report, this time after the publication in the media of some interceptions of the Italian Antimafia, where exponents of "Ndragheta" claimed that they had contacts with high-ranking officials in Albania. Immediately after these publications, Arben Kraja traveled to Italy and when he returned, the launch of the investigation was announced, mainly on the initiative of the SPAK itself.

To come to a fresher case, in February of this year when SPAK announced the launch of investigations for a tender of the Albanian Development Fund worth 400 thousand euros to create a menu of 100 villages. The winner of the tender was announced the chef of the restaurant of the son of the head of the ADF. SPAK started the investigation without a report, while the ADF withdrew from signing the contract with the winner.

Për Berishën dosja është gati dhe është hartuar nga përtej Atlantikut. A s’mjafton shpallja ‘non grata’ për korrupsion madhor për ta hetuar? Nëse jo, atëherë ka dosje të tjera që asnjëherë nuk janë hetuar thelbësisht, që nga Gërdeci, 21 janari, (këtu mund të marrë edhe dëshminë e Lulzim Bashës dhe deklaratave që ai ka bërë këto muaj), privatizimi i kompleksit Partizani, batërdia me lejet për hidrocentrale pasi Berisha kishte humbur zgjedhjet në 2013-n dhe të tjera si këto.

Për Berishën mund të marrë dëshmitar edhe vetë Ramën. Ky i fundit ka shprehur gatishmërinë që të shkojë të dëshmojë se çfarë di për korrupsionin e Sali Berishës dhe nga deklaratat që ka bërë, ka nënkuptuar se jo të gjitha i ka thënë publikisht.

Për më tepër, asnjëra prej këtyre dosjeve nuk është hetuar e plotë. Nëse SPAK vendos ta bëjë një gjë të tillë në mënyrë të pavarur dhe të paanshme, ndoshta mes të pandehurve del emri i Sali Berishës dhe familjarëve të tij, ashtu sikundër janë akuzuar për vite me radhë tashmë.

Edhe për Ilir Metën vlen e njëjta gjë. Ai mund të hetohet për grabitjen e floririt në Kërrabë, që ndodhi kur ai ishte Kryeministër. Në këtë rast dëshmitar mund të merret Sali Berisha, sepse ka qenë i pari që e ka akuzuar për zhdukjen e 200 e ca kilogramëve flori duke i vënë edhe nofkën “Ilir Floriri”.

Having said all this, more than procedural, legal or lack of evidence, not launching investigations into Sali Berisha and Ilir Meta is a matter of will, which can not be covered by any form of alibi.

Therefore, if Arben Kraja is not able to do what the SPAK was set up for, that is, to investigate and punish the 'big fish' of corruption, maybe it is time to open his arms as a leader, and maybe as a prosecutor special.
