The second level of Vetting, the Special Board of Appeal has changed the decision of the Independent Qualification Commission for the subject of re-evaluation, Niko Rapi, returning him to office as a judge of the Tirana Judicial District Court.

Raqi was dismissed from the first level of vetting due to a conflict of interest at the time he was leading the Court of Pogradec.

The Evaluation Commission raised doubts about possible preferential treatment and situation of conflict of interest conditions on a friendly relationship between judge Niko Rapi and the company "Bregu sh.pk".

KPA announcement:

The judging panel of the Special Appeal Board, consisting of Ina Rama chairperson, Natasha Mulaj relator, Albana Shtylla, Mimoza Tasi, Sokol Çomo members, announced the decision on the case (JR) no. 54/2020, dated 27.11.2020, which is related to the appeal of the re-evaluation subject Niko Rapi against the decision of the Independent Qualification Commission no. 277, dated 21.07.2020.

At the end of the trial in the counseling room, the panel of judges, based on article 66, point 1, letter "b" of law no. 84/2016, "On the transitional re-evaluation of judges and prosecutors in the Republic of Albania", unanimously decided :

1. Change of decision no. 277, dated 21.07.2020 of the Independent Qualification Commission and the confirmation of the re-evaluation subject Niko Rapi in the position of judge of the Tirana Judicial District Court.

2. This decision is final and has immediate effect.

It was announced today, in Tirana, on 08.11.2022.
