The Special Court has sentenced the former IKMT inspector, Julian Preni, as well as the Saranda Urban Planning official, Arjel Balani, to two years in prison for the crime of corruption.

According to SPAK, Arjel Balani asked Foti Doda for 12,000 euros to issue a permit for beach use in Ksamil.

"Balani took 6,000 euros from Doda in 2021 to issue a beach permit, but he didn't make it and returned the money," says SPAK.

Announcement of GJKKO:

1. Special Prosecutor's Office against Corruption and Organized Crime, dated 16.05.2024, No. Reg. I say. 80, submitted to the Court the request with the object: examination of the criminal case against the defendants: Julian Preni, accused of committing the criminal offense "Passive corruption of persons exercising public functions", provided by article 259 of the Criminal Code; Arjel Balani accused of committing the criminal offense "Exercising illegal influence on persons exercising public functions", provided by article 245/1 paragraph 4 of the Criminal Code; Foti Doda accused of committing the criminal offenses of "Exercising illegal influence on persons exercising public functions" and "Active corruption of persons exercising public functions", provided by articles 245/1 paragraph 2, 244 of the Criminal Code.

2. The trial of this case took place with the rules of summary trial. At the end of the judicial review, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Erjon Çela, Etleva Deda and Erjon Bani based on articles 35, 59, 244, 245/1 para. 2 and 4 and 259 of the Penal Code, articles 190, 403 - 406, 393 and 485 of the Penal Code, with decision No. 40, dated 26.06.2024 decided:

The guilty declaration of the defendant Julian Preni, for the commission of the criminal offense "Passive corruption of persons exercising public functions" provided by article 259 of the Penal Code (before the changes made by law no. 43/2021), and in based on this provision, his punishment with 2 (two) years of imprisonment.

4. In application of Article 406 of the Penal Code, reducing the sentence by 1/3, finally sentencing the defendant Julian Preni to 1 (one) year and 4 (four) months of imprisonment.

5. The serving of the sentence for the defendant Julian Preni will start from the day that the personal security measure "Arrest in prison" was implemented against him and will be carried out in an IEVP, ordinary security prison.

6. In application of Article 35 of the Penal Code, the removal of the right to exercise public functions for the defendant Julian Preni for a period of 5 years.

7. Deklarimin fajtor të të pandehurit Arjel Balani, për kryerjen e veprës penale “Ushtrimi i ndikimit të paligjshëm ndaj personave që ushtrojnë funksione publike” e parashikuar nga neni 245/1, paragrafi katër i Kodit Penal, dhe në bazë të kësaj dispozite dënimin e tij me 2 (dy) vjet burgim.

8. Në aplikim të nenit 406 te K.Pr.Penale uljen e dënimit me 1/3 duke e dënuar përfundimisht të pandehurin Arjel Balani me 1 (një) vit e 4 (katër) muaj burgim.

9. Vuajtja e dënimit për të pandehurin Arjel Balani do të fillojë nga dita që ndaj tij është zbatuar masa e sigurimit personal “Arrest në burg” dhe do të kryhet në një IEVP, burg i sigurisë së zakonshme.

10. Në aplikim të nenit 35 të K.Penal heqjen e të drejtës për të ushtruar funksione publike për të pandehurin Arjel Balani për një periudhë kohore prej 5 vjetësh.

11. Deklarimin fajtor të të pandehurit Foti Doda për kryerjen e veprës penale “Korrupsioni aktiv i personave që ushtrojne funksione publike” e parashikuar nga neni 244 i K.Penal (para ndryshimeve të pësuara me ligjin nr. 43/2021), dhe në bazë të kësaj dispozite dënimin e tij me 6 (gjashtë) muaj burgim.

12. Deklarimin fajtor të të pandehurit Foti Doda për kryerjen e veprës penale “Ushtrimi i ndikimit të paligjshëm ndaj personave që ushtrojnë funksione publike” e parashikuar nga neni 245/1, paragrafi i dytë i Kodit Penal, dhe në bazë të kësaj dispozite dënimin e tij me 1 (një) vit burgim.

13. Në aplikim të nenit 55 të Kodit Penal mbi caktimin e dënimit për kryerjen e dy veprave penale, dënimin e të pandehurit Foti Doda me një dënim të vetëm prej 1 (një) viti burgim.

14. Në aplikim 406 te K.Pr.Penale uljen e dënimit me 1/3 duke e dënuar përfundimisht të pandehurin Foti Doda me 8 (tetë) muaj burgim.

15. Në aplikim të nenit 59 të K.Penal urdhërohet pezullimi i ekzekutimit të vendimit të dënimit me burgim duke e vënë të pandehurin Foti Doda në provë për një periudhë kohe prej 16 (gjashtëmbëdhjetë) muaj, me kusht që gjatë kësaj kohe të mos kryeje vepër tjetër penale si dhe të mbajë kontakte të rregullta me Zyrën e Shërbimit të Provës ku ka vëndbanimin e tij.

16. Në lidhje me provat materiale të sekuestruara për llogari të këtij procedimi penal, gjykata në bazë të nenit 190 të K.Pr.Penale disponon si më poshtë:

⎯ Mobile phone type "IPHONE 12 Pro Max", model A2411, with no. IMEI 1: * and IMEI *, used by the defendant Arjel Balani, is returned to the defendant in accordance with article 190/1 letter "ç" of the Penal Code, after the decision has become final.
⎯ "Iphone 13 Pro Max" mobile device, model A2643, white color, switched off, with IMEI stamped on the bottom of the card *, used by the defendant Julian Preni, is returned to the defendant in accordance with the article 190/1 letter "ç" of the Penal Code, after the decision has become final. ⎯ "Samsung" type mobile phone, model SM-*, black color, switched off, with IMEI 1: * and Imei 2: *, used by citizen Sofia Doda, is returned to this citizen in accordance with Article 190/1 letter "ç" of the Penal Code, after the decision has become final.
⎯ CD-R disc, with the inscription "Kodak" with the blue note "Fiks Fare, October 2022" with the footage of the show on the case of the citizen Foti Doda, piece 1 (one), to stay in the file.

1. Procedural expenses incurred during the investigation phase in the amount determined in the relevant minutes (33,840.03 lek), which, based on Article 485/1 of the Criminal Code, have been prepaid by the state, as well as the court costs to be charged the defendants jointly and severally, based on articles 393/1 and 406/4 of the Criminal Code.
2. Against this decision, an appeal can be made by the parties within 15 (fifteen) days to the Special Court of Appeal for Corruption and Organized Crime, which period starts from the day after the announcement of the decision.
