Notaries have drawn up a draft where they propose that divorces when there is an agreement between the couple should not end in court, but be done with simple notarial acts.
The initiative was taken by the head of the training center, notary Elona Saliaj, who argues that this initiative was prompted by the high number of stock files in the courts, but also by the restructuring of the justice system that is taking place recently in our country. with a new judicial map.
For this proposal, it is said that an example has been taken from other countries, including Greece, Spain, Latvia, Romania, where the marriage settlement is done at a notary.
" If the spouses have agreed on the dissolution of the marriage, a notarial deed must be made and filed in the civil registry. If they agree that the children will be left for growth and education to one parent and the maintenance obligation to the other parent, then the notary must appoint a psychologist and after receiving the report prepared by him, it is attached to the relevant act. Of course, at any time if the other parent does not agree with this method, he can ask the court at any time for the removal of parental responsibility ," the draft proposal states.
In the draft notarized agreement, it is emphasized that a divorce in court takes a lot of time, ranging from 28 days to 207 days, which can also trigger conflicts between families, since the parties cannot make any decisions such as obtaining a loan, buying an estate in a personal name.
