Call center fraud/ SPAK hits the group in Tirana! (8 security measures are

The investigations began after checks at the "Bluenergycall" call center in Tirana.

According to SPAK, victims were invited to invest in fraudulent platforms, while the money was transferred to accounts abroad and converted into cryptocurrencies.

The security measures executed are as follows:

Gj, G.Sh and EP – “Arrest in prison”, as persons suspected of committing the criminal offense; “Computer fraud”, in collaboration, to the detriment of several persons, in the form of a structured criminal group, “Structured criminal group”, “Commitment of criminal offenses by a criminal organization and a structured criminal group”, provided for by articles 143/b/2, 28/4, 333/a/2 and 334/1 of the Criminal Code.
Gj. KB and IG – “House arrest”, provided for by article 237 of the Criminal Procedure Code, suspected of the criminal offense of “Computer fraud”, in collaboration, in the form of a structured criminal group, “Structured criminal group”, “Commitment of criminal offenses by a criminal organization and a structured criminal group”, provided for by articles 143/b/1, 28/4, 333/a/2 and 334/1 of the Criminal Code.

Gj and Dh.L – “Obligation to report to the judicial police”, provided for by article 234 of the Criminal Procedure Code, as suspects for the criminal offenses of “Computer fraud”, in collaboration, provided for by article 143/b paragraph 2 of the Criminal Code.

The Special Prosecution Office against Corruption and Organized Crime registered criminal proceedings no. 300, on 9.12.2021, for the criminal offenses: "Computer Fraud", committed in collaboration in the form of a structured criminal group, provided for as a criminal offense by Articles 143/b, 28/4, 333/a and 334 of the Criminal Code.

Based on the request for legal assistance from the German justice authorities, namely the Bamberg General Prosecutor's Office and in implementation of the Decisions of the Special Court against Corruption and Organized Crime (GJKKO), on 16.3.2022, inspections were carried out at the premises of the entity "Bluenergycall shpk" and its related entities.

Fraud scheme

From the seized material evidence and from the acts of criminal proceeding file no. 300 of 2021, processed in cooperation with German judicial authorities, it has resulted that German citizens and other European citizens were invited by agents of "Bluenergycall shpk" to invest in international stock exchanges by depositing money on fraudulent platforms.

The deposits of money were made in bank accounts in various countries such as; Bulgaria, Lithuania, Poland, Cyprus, etc., in other European countries and beyond and then disappeared through successive transfers or conversion into cryptocurrency. It has also been confirmed that the fraud was committed through two IP addresses, used by the entity “Bluenergycall shpk”, in Albania. During the inspection carried out on 16.3.2022, direct electronic data was extracted and analyzed by the German justice authorities and specifically, by the Bamberg General Prosecutor's Office for cybercrime.

Within the framework of this investigation, the Special Prosecution Office has initially sent for trial the owner, the IT of the call center, "Bluenergycall shpk", accused of committing the criminal offense; "Computer fraud", in collaboration, in the form of a structured criminal group, "Creation and participation in a structured criminal group", provided for by articles 143/b/2, 28/4, 333/a/1 and 334/1 of the Criminal Code, as well as 11 other citizens, accused only of committing the criminal offense: "Participation in a structured criminal group", provided for by article 333/a, second paragraph of the Criminal Code. Investigations into unidentified persons involved in this activity continued within the framework of separate proceedings 300/1 of 2021.

The security measures executed yesterday are the result of extensive work on the detailed analysis of computer data, compared with other physical evidence, as well as the checks mentioned above, through which the identification of other members of the structured criminal group was enabled.
